Thank you so much for responding to Louise's request for Policies regarding the usage of electric carts and wheel-
chairs. After typing up our own policy based on those that we received, we had it reviewed by a member of the Idaho Task Force for the ADA. He said that if it were ever chal-
lenged legally we "wouldn't have a leg to stand on" because
we cannot discriminate against those who use the electric vehicles. He said that we could develop a general policy that pertains to every Resident to address some of the issues, but cannot have a separate policy that applies only to the electric vehicle owners. It is illegal to require the Residents with the vehicles to carry liability insurance, and we cannot at any time revoke their privilege to use their vehicle.
I thought it was important to share this information due to the legal liability of the facilities with regard to the ADA and other federal laws that could be unknowingly violated.
