what to do if u have signed a timeshare?
1. approach CASE [www.case.org.sg]
2. approach free legal clinics [various community centres]
3. approach your member of parliament, to ask them to raise the issue in parliament
4. approach the commercial affairs department [www.cad.gov.sg] if u think there is fraud/cheating involved

Hi Chong_Ong,

the next best bet is to go to a lawyer and see what they can advise you on. But ask for a "free" session from the lawyer firm, so you don't have to pay them for consultation. Am sure most smaller firms would be glad to give you some advice. But of course if you want advice from "Drew & Napier" or "Lee & Lee" then you can forget about getting a free session. :)

I had bought a time share from World Resorts International Pte Ltd and have been paying yearly increases in management fees since. Please let me know how I should approach this problem.
I had been approached by Global Europ who claimed that they can terminate this by paying approx. S$7,500.
Please let me have your experience and what you are doing with the time share right now.

Hi, noticed that you have "CEASER INDEPENDENT ADVISORY SERVICES" in your list. Do you have more info on this company? One of their chaps called me up and told me that they're doing some investigation on LGM's misdeeds, and that they hope to be able to raise a suit against them when they've gathered enough victims who were conned by LGM. Wanted me to go down to their office at Park Lane, Selegie Rd, to make a report. Says my case (see hyperlink http://www.voy.com/161450/1802.html ) was complicated and the report need to be sent urgently, etc.

I didn't go in the end cos I wasn't available the on the "appointment day". So was wondering if anyone has dealt with or come in contact with the above company. Do share with us if this company is another BIG SCAM.

I've their contact nos for both HK, Sing & Taiwan. But no work. And I also try their Websit which is www.jnkintl.com, also doesn't work. So I believe they no longer in the world anymore.

Hi sgwatchdog, is every name in the list you provided to be watched out ?

Yesterday, I received a call from Emerald Networth Consultancy (located at Raffles Quay, John Hancock Tower) asking me to visit them about my Toshali Sands membership and they offered to help me to get back my money. I was not sure whether it is genuine or another company trying to cheat my money so I turned them down eventually. I made some search in the internet about this company and timeshare scandals, glad to find this forum.

I bought the membership from Premier Holidays in 1995 but did not get to use it. In 2001, I was persuaded by Toshali Marketing Pte Ltd (just shifted from Jalan Sultan Textile Centre to Kelantan Lane) to convert this membership into their Club Leisure International membership with additional payment of $3k (after much reduction as I was initially not attracted). I converted it in view of the rising maintenance fee for Toshali Sands resort and the low CLI subscription fee ($50 per yr). I only need to pay for the booking fee (equivalent to RCI exchange fee) whenever I make accommodation reservation (1 week stay), no need to subscribe to RCI. They have collected my Toshali Sands certificate from me and asked me to sign some form to say that I agreed to terminate the TS membership in exchange for the CLI membership.

Unfortunately, I tried to request for accommodation reservation twice with CLI without success. I thought the first year was due to short notice but I gave 3 mths notice last year. The destination was Las Vegas and travel time was in Aug 05, not a peak period.

Now the chap from ENC told me that I am in fact still an active member of Toshali Sands and I will have a lifetime liability on the maintenance fees which will pass on to my next generation. He said that they will ask me to pay a one lump sum after 5 yrs not making any payment.

Can someone advise me on:

1) is what the ENC chap said abt lifetime liability true ?

2) how to contact Toshali Sands to find out the status of my membership ? I am not sure whether the website address that I found using search engine is genuine, sigh...

3)any bad or good experience with Club Leisure International membership and Toshali Marketing Pte Ltd? Is it also a scandal ?

4) any successful claim by ENC or cheated case by ENC ?

To be honest with u initially i was reluctant to be part of their participation,but what happened on my part is that i paid an amount due to the fact that the ppl of ENC told me that by certain weeks if they cant cancel the membership whatever happen they give me a black and white that they will refund back whatever amount i pay.i hav been bitten with alot of companies asking me to pay n pay n pay.ofcoz i felt so doubtful in this termination thing.
As i made ma payment,the next day they set up an appointment wif me with their lawyer as i told them that if they are really true,n i hav a cooling of period,let me see their lawyer as i m not a fool either as i was given by them the NOTICE OF CANCELLATION which the contract officer stress me out again n again abt the FTA act.
I met with their lawyer and i found out whatever they hav claimed,turns to b true.until now i even had a correspondence by the lawyer of my membership getting terminated.i m not on their side but i based on black and white that i have seen in ma own eyes..if u hav doubt abt wad i say feel free to text me up or look me up in here.

i would not trust any company that claims that they can do this do that, unless the other company agrees to it. e.g. if ABC claims that DEF's contract is still valid, and that you are liable for maintenance, ask DEF directly or let CASE have a look at the contract...
similarly if ABC claims that they can terminate DEF's timeshare, pay only when you see a letter from DEF saying that the timeshare is terminated.
its as simple as that. a 3rd party [not even CASE or lawyers] cannot help you to terminate [or change terms & conditions] unless some laws were broken when you signed the timeshare...

Your Toshali Sands(india) timeshare will automatically get terminated if you do not pay up your maintenance fee. That is all that will happen. There is no such crap as a "lifetime liability". If you don't want it anymore, just leave it alone. It will eventually get terminated for non payment of maintenace fee. If one day someone from some company call you up saying that you need to pay this and that, don't waste your time with them.

Btw, whatever you have spent so far on this timeshare escapade, is as good as gone. Just leave this all behind and get on with your life.

when you sign a legal binding contract.. trying reading and understanding the clauses.. whatever amount you pay for the initial m/ship.. it goes to the marketing company.who do you think the developers will come after for the maintainence of the one week period a member bought by agreeing and signing the contract????? it's revenue for them. they will milk you dry in the long run!!! anyway if you wanna treat it as a bad debt or a losing investment...just sit on it and pray....

Hi all

Just one fine day recently, a thought dawned upon me.

Every timeshare victim assumed directors of these timeshare companies cheated people's money for their own benefits. Has anyone ever thought PERHAPS these timeshare scamming which has been going on for many years, PERHAPS with many victims stopped trying any means to get their money back because they failed repeatedly & PERHAPS with huge sums accumulated by the timeshare companies (worldwide total amounts not remitted to respective resorts, not just Singapore), can PERHAPS be one of the avenues for terrorism funding for one or for some. If not so now, it might be so in future because locally we don't see much success for the victims to recover money, not even 1%. It's very UNTHINKABLE & I HOPE NOT with all my heart but who is to know! I can foresee the next countries these timeshare companies may PERHAPS want to target are India and China with huge population or PERHAPS the seeds have already been sowed.

The company names in the timeshare list can always change over the months/years. All the directors have to do is close down company & start a new one. There ought to be some controls at ACRA level by liaising with CASE, ie once a company has been identified as a company conducting timeshare activities and subsequently close down its operations in Singapore and start up another company, the new company operations ought to be under tight scrutiny by CASE. PERHAPS the bank accounts of the current directors of the companies and the companies in this timeshare list should be regularly scrutinised by MAS for unusual amounts & the recipients. This is just a suggestion, I'm sure there are many other ways & I'm not an elite.

This has been a long, dragging issue, certainly hope something good enough (not the best, nevermind, can keep improving) can happen soon and we certainly need the government support.

Me and my husband were called by a company called Global Europ. They claimed they can terminate our timeshare that we bougt by showing us some termination letter issued by k.S Chia Gurdeep & Param Advocates & Solicitors. We end up signing an agreement to pay them 10K (paid 5K so far)for the termination which they claimed should take around 3-4 weeks, but usualy by 1 week we should be able to get the letter of termination. Then they ask us to come back once we get the letter to write an affidavit and settle the remaining 5K.

The company's name is in the timeshare list that u've writen. Is this a good thing or we has been trapped by another company. PLS PLS help...!!!!

Last week s/one from Global Europ called us and inform us that our termination with HCAP is successful and we will receive a letter from their legal firm stating the contract is terminated. Few days later, we got a letter from K.S Chia Gurdeep & Param Advocates & Solicitors. The letter stated that we are no longer with HCAP and our contract is terminated. Now we don't know how to react thinking is this true or just a scam.

And the person from Global Europ advise us once we get termination letter, do not sign up a/thg regarding timeshare a/more and if anything happens, pls contact them. Not sure whether this is a genuine advise or just an act.

nOW we have sign agreement with Global Europ and have an outstanding payment of 5K to them. They told us to pay the remaining balance and then we would be able to recover around 65% of our money within 9-10 mnth time.

Do u think its a genuine termination or....anyone has any advise?????? Anyone heard of K.S Chia Gurdeep & Param Advocates & Solicitors that handles termination of timeshare?

If in reality, you were already NOT a member yet of HCAP but you were made believe that you are a member of HCAP before this letter from their legal firm, K.S Chia Gurdeep & Param Advocates & Solicitors, then anyone can issue you a letter stating that you are no longer with HCAP and that your HCAP contract is terminated.

My last message applies in the case of Global Europ taking over outstandings of closed down companies like those links I've provided you earlier on regarding Global Europ.

As for your case, if you are still paying for HCAP package, you are not a member yet and if it's less than $10k, you simply stop payment and you won't be declared a bankrupt. The Small Claims Tribunal has no powers to hear your claim because it is a time-share claim. Goto http://www.smallclaims.gov.sg/SCT-Lodging_a_Claim.html and click on checklist under point one, it's explicitly stated there. Therefore Global Europ also cannot use Small Claims Tribunal services against you.

Do what deems fit, only you know best. Suggest you read the cases from this forum, long but good enough for your decision making.

KS Chia Gurdeep & Param is an existing law firm. I been to their office to verify their status. They are also registered with Singapore Law Society. Did your aggreement signed with Global Europ indicate that you ar able to recover ur monies back? This is very important. I am also a victim. a lawyer's letter does nothing in this situation

only an official letter from HCAP telling u that "you have no liabilities" will suffice

how can company B, which does not control company A, tell u that your contract with company A is no longer in force?

Hi to all. Word of Caution for yet to be ppl and advise to all that have been conned. All names listed in the list are Timeshare or Timeshare related companies. None is genuine in their tactics. Do not seek any advice or pay any monies to all of them. As advised by sgwatch on the specific resort/company you bought from can cancel your membership. No law firm can confirm that your membership is terminated.

Actually, i have signed up another termination contact to terminate my timeshare since i don't really want to pay my maintenance fee. After much thought, i regret it. So i am wondering if there anybody who has try to break this contact? How do you go about doing it?
