To All EMTPA Members, The Eastern Michigan Tractor
Pulling Association is $381.09 overdrawn in their checking account at the
Tri-County Bank in Peck. The account has been in overdraft since 8-20-03. With
the pulling season over for the year, if EMTPA does not have $381.09 to cover
their overdraft, I guess it is safe to say they are in big trouble, and have
been managed very poorly. Jim Nolan has received a letter from me on 9-28-02
terminating my membership as Treasurer. He was given all the correct paper work
to get another members name on the checking account and take my name off. He
promised over and over, for a year, he would take care of this matter. But
instead he continues to bounce checks with my name and address on them. He
leaves me no choice but to take him to court and sue him and the entire Eastern
Michigan Tractor Pulling Association. My credit has been damaged by EMTPA
bouncing checks with my name and address on them. I will seek damages in court.
I have instructed Tri-County Bank to send me copies of all EMTPA transactions
in the checking account. With my name of the account- I CAN DO THAT!Send a self
addressed stampted envelope to the address below and I will send you copies of

Ouch!! I guess brush pulls aren't as popular as you
guys thought. Sorry, but 25 fans a pull doesn't pay the bills, boys!!

Its been a well known fact that Jim Nolan will get
into anyone shorts he can for a buck. I feel bad for the member that have gone
out of their way in supporting the club.

Well Dave I think that is something you should have
brougt to the meeting of the EMTPA. I think I just saw you at a pull with the
EMPTA. You should have talked to more than Jim about it he doesn't run the club
by himself, you should know that by now. Instead you want the EMTPA or The TTPA
to look bad whenever you get a bug up you butt about something. If this has
been happening than you should have sent a certified letter to The EMTPA and to
the bank stating you wanted your name off and it would have been that easy.
Besides from what I understand the EMTPA does not use that bank anymore and
they are in good standings. So before you go blowing noise, let the people you
are trying to embarrass know!!!!!

is all pissed at the eastern club, but dont worry ,,that was how he was at the
thumb but now he kisses there butt,,now thumb puller the thumb doesnt fill the
stands either,,and dave does slander or counter sute ring a bell saying what
you did on this web site well the shoe could be on the other foot real
fast,,the court system is nothing to play with,,,and this isnt divorce

What's the matter, nothing better to do now that the
season is over than start another rumor? You and Gary Nelson have been trying
to cause us grief all season. You both walked away from the club last year, now
why can't you guys just grow up and leave it alone. And Dave, you resigned last
year, what is your name doing on an account that you say is ours?

Dear Mr. WOW (great, another manure spreader afraid
to post his name), You must be thinking of someone else and using Jim's name
mistakenly. The Jim Nolan I know has busted his hump supporting this new club
and I am proud to call him friend. He has donated a great deal of material,
time, fuel, use of his equipment, etc. to help with the improvements to the
club's sled and related equipment. Most of the time, he is the one that
transports the sled and equip from pull to pull with his personal vehicles!
Often it is he and his equipment that readies the track for a pull. He is very
supportive of new pullers and has let newbie pullers (including me) pull his
very competitive and winning tractor! Would you trust a newbie on your tractor
(if you even own one)? Have you helped budding tractor pullers with tips on
wheelie bar construction, how to read a track, how to adjust a carb and answer
countless and probably sometimes stupid questions? Jim Nolan does this kind of
stuff! Are your cloths filthy and sweat soaked and your skin dusty and
sunburned after a day at the pull? If not, have you at least walked up to Jim
and the others fitting that description, offered him/them a cold drink and a
"thank you" for their effort to try and make your pull a pleasent experience?
No, you are the one that complains because of the time it took to do an
emergency repair on the sled or because a track official made a mistake in the
line-up (you never make a mistake or inconvenience anyone, in your mind at
least). If ever there was an ambassador for antique and farm tractor pulling,
Jim is that person! Is he perfect? No. Do I always agree with his ideas or he
with mine? No. His name will long be remembered as a major contributor to the
antique and farm pulling scene long after he is gone. Will you leave such a
legacy behind? Although, no one knows your name now, how will we be able to
know it then? Then again, it is probably best that way. Come my "friend" to our
meetings, meet us at the pulls, but come only with an attitude of wanting to be
part of something that is great. If you only come looking for negative, you
will find it because Jim and the rest of us are not perfect. Come looking for
the positive, comraderie and fun, sir, and I assure you, you will definitly
find that and that's what we're about!!!

Who cares if 25 fans doesn't pay the bills? EMTPA
doesn't charge admission. Besides, there's way more than 25 fans there. They're
not in the lawn chairs, they're out on the track with us. This summer I got the
chance to get out of the stands and put some power in the track. Might have
only been 40 or 50 hp instead of 400 or 5000, but it felt great just the same.
Even bagged a few wins along the way. I've waited years to do that, but
couldn't because as Mark says, very few people will trust you with their
tractor when they hardly know you. Lord knows I'd be thinking long and hard
about that.Whatever the circumstances are EMTPA isn't going away and there is a
place for it and Thumb and I hope to pull with both groups in the future.CP

Maybe the emtpa doesn't use the Peck bank anymore,
but Jim still does. Why doesn't he sign off on that account if your club has a
new account somewhere else? Would Mr. Burns put his tail on the line if there
wasn't some truth to what he says? His mailing address is there, and maybe you
should inquire instead of throwing rocks. How long have you known this Jim guy?
Maybe there's another side of this guy that some of you people don't know
about.

Thanks Mark for an excellant post. You said it far
better than what I could have. I am one who started pulling for the first time
this year & I do appreciate the EMTPA & its members, many which I
consider to be friends. All that I have met have been more than helpful &
often gone out of their way to get me going down the right path. I'm grateful
for Jim & the EMTPA because without them I probably wouldnt be in tractor
pulling due to the fact that the TTPA doesnt have a class for my tractor. I
dont want anybody to think by that statement I'm runing TTPA down I think there
is room for both organizations.Mr Burns I dont know you but I do think there
was a better way to handle this then to use a public form. I'm not sure what
you were trying to prove but I hope you are happy now.

I do believe you people are missing the point. The
topic was "Checking account." It wasn't about spectators. It was a great idea
of Mr. Burns to bring this idea out in the open, everybody should know how the
EMTPA really works.

I have been a member of many clubs through my years,
and many club have had people handle the checking account. But that person was
only a signature person not a responsible party for the checks. In order for
your credit to be wrecked Mr. Burns you would have had to put your SS# on the
account, and not the clubs I.D.! That way you would not be responible for the
club financial affairs. If you gave your SS#, you know as well as I do you
never let anyone else be responsible for something in you name or SS#!!! That
you can only blamed on yourself, no matter how trusting you think people are or

Well I guess that Mr. Mark Schwab has never had any
business dealing with Jim Nolan, maybe he is great for the club but watch your
tail or he could get you to. I know from past experince on dealing with him
that I would not trust him any further then I could throw him.Mr. Burn I think
you are total right for posting you matter on the post after all its you butt
that is on the line, and Peck is a small town & you known how people can
flap their jaws.P.S. Its MS. Not Mr. let not asume...

sideline observer: You are including the entire club.
To me it sounds like this issue is really between 2 people that have not dealth
with financial issue properly. So for the members that have no ideal what is
happening, I personally would not include you. NOR SHOULD ANYONE ELSE!!!

I see by some of the replies that some EMTPA members
are mad! GOOD! Maybe now something will be done about this checking account
situation. I am not writing checks out of your account, you are doing it to me!
Maybe you should find out who is writing these checks. Why isn't there enough
money to cover this overdraft bill? Where is your treasurer's report? Why isn't
your treasurer writing checks for the EMTPA? Some of you members are pointing
the finger of blame blindly in the dark. I am not trying to hurt your
association or is Gary Nelson. You have hurt yourselves. Your problems come
from within. The Tri-County Bank is taking me to court for your outstanding
bill! Why don't you find out why these checks are being bounced and stop this
foolishness. If I get taken to court and sued, you can bet that you will be
next! Why don't you just pay up the account in Peck and put this behind us.
Your association has been hurt by your "NO ONE TELLS US WHAT TO DO"attitude.
When you tell customers that they cannot have the weight classes they want and
have to use only what you insist on, your business will fail for sure. The
checking account at Peck is still waiting for their money and the account has
been handed to the collection Dept. PAY YOUR BILLS!!!!I tried to help this
association to the extreme point where push became shove. I cannot belong to an
association that would act the way this one did in Imlay City last year and do
what you did to Gary Nelson. If management ever changes maybe some of us can

Just as I stated earlier when Dave gets mad!!!! You
will never hear the end until he gets his way. And the check thing at Peck just
gave him a forum to complain about it!!!! Dave if you would be at the club
meetings you would know what is happening but you are mad at Jim and you take
it out on the whole club. You never told anyone about this issue and if you are
being taken to court it must have been going on for more than 3 months!! You
have had time to have it resolved by more than Jim! You know who the current
treasure is so you should have went to HIM!!!!!!!!

Meetings? The EMTPA hasn't had one in months! Jim is
the dictator of the EMTPA. Eveyone knows he runs the club HIS WAY, why can't he
take care of it? Why doesn't Jim Stick up for himself instead of you doing it
for him?

I am not sticking up for Jim. Why hasn't Dave
followed the correct methods? JIM is a big man he does not need me. I do not
know why Jim has not been on here. If he felt it necessary I bet he would be.
EMTPA doesn't have meeting in the summer but there is a pull almost every other
weekend. He could have went there. OPEN TO THE PUBLIC I BELIEVE. And according
to EMTPA.org, Dave is still a member!!!!! Could have posted it on there, but he
wanted to inform the members, but never posted anything on there? I have to
question Mr. Burns methods??????

When checking EMTPA's website, it only shows charter
members (i.e. founding members), not current members.

Dave, first off, not including a weight class????????
2750 to 10,000, five divisions, mods, nostalgias, and pickups, not to mention
if you show up, regardless of what you bring, we'll let you hook, if we feel
it's safe. Obviously, we aren't going to hook unlimited mods or open supers. I
sure wouldn't say we're offering a limited number of classes. Wasn't it you who
got mad and quit last year because you didn't want to let 2 guys hook in Imlay
City?? As for Jim not being on here, for those of you worried about him, he has
been having computer problems for the last month. "Why isn't the treasurer
paying bills?" someone asked. I am, out of a different account. I have nothing
to do with this "Peck account". Nor, do I have any knowledge of it. Also, as
someone else mentioned, I sure wouldn't go off half-cocked and attack the whole
club over this. Seems to me you've got it in for Jim, so....why not pick up the
phone?

I was wondering what would be coming from the whiners
this year. If you guys remember last year it was a rumor that we didn,t pay our
payments and were broke. I did receive a letter from Mr. Burns this past
summer. I would call it a hate letter about how I have singlehandledly ruined
all pulling for the small tractors in the thumb and our sled was a piece of
junk that would we would lose in the end. Since then I have not heard a single
peep out of him. As many pullers from all over at least 3 states have called me
on my home phone and cell phone I,ll assume he could have found out how to call
me if he wanted to. He has found time to back stab me and the club for the last
year but something as serious as his checking act doesn,t deserve his time to
call or write. Yes it is his account not the EMTPA. When we as a club gave him
the paperwork and authority to open a checking he did not use our Federal ID
numbers but instead put his own social security numbers on it and never told
anyone different. I believe that was illegal and he did so knowingly. The same
as the Brown City Committee checking is in Dave Burns Name only. He is the
committee and could keep all the funds himself. I know last spring when we lost
Brown City Because someone started a rumor we had no insurance the committee
suddenly made a donation to the city to cover the previous year that hadn,t
been paid. The city was not ready to rent the park to us because the previous
years promise had not been kept. I told the city we would pay the rent in
advance and have our ins.cert. to them before the pull. In the end it was
called off because of this confusion. Mr. Burns needs to close his account and
then act like a man to settle this, not threaten me or our club. I don,t
respond to threats very well and our club is too important to let some jealous
single minded whiner run it down. We have had some differences among us this
year and some were my fault and some were not. All I know for sure is you won,t
find a better group to belong to and I am proud of what this group has
done.Starting from nothing to what we are today is nothing short of amazing.
Considering all the BS slung at us we are doing well and I don,t have a doubt
in my mind that several if not all of our members could replace me and do my
job. I am proud of all the guys young and old and their spouses for giving up
their time and making donations to help out. There was a time Mr Burns was in
that group but his need to have everything his way or no way caused him to
leave. He is still bitter and as someone said he doesn,t give up, oh well I
won,t waste any more time on his problems. My phone works and I have used it to
call my attorney since hearing about this story. We will see what happens, but
I won,t respond on this subject again on this forum. Jim

Dave,It's amazes me that you would state "He was

that has more then one name on it,ask anyone that has tried to take a ex-wife's
name off a account.A corporate account it can be done.Also "He promised over
and over,for a year,he would take care of this matter". When was the last time
you called him or spoke to him personally? When you became aware of a overdrawn
account why didn't anyone in the EMTPA hear about it till now? The EMTPA is
alive and finacially well,but you wouldn't know that since you haven't informed
anyone on the EMTPA board that you have a outstanding balance on a checking
account you opened in your name for the EMTPA.A phone call to Jim,or any of the
other numbers of officers you could find by dialing 555-1212,or posting at the
forum at WWW.EMTPA.ORG, could have got this resolved faster then posting on
here and now having everyone wonder about you and your motive.I'm sure as soon
as the club gets a copy of the bank statements supporting your what you
claim,the bill will be paid.
