Exorbitant awards punish everybody, not just the guilty. It isn't just the negligent doctor that has his malpractice insurance go sky high, it's you and me and everybody else who has to rely on health insurance. - Insurance companies often do settle and it is cheaper in the long run. Medical malpractice trials are very costly and worse if they lose - better to "settle out" and then pass the increases along to the public.
Don't get me wrong, Diva, I'm not condoning "non-punishment" of the offenders. But, I still say in the case we are discussing, $15 million, plus the childs medical expenses for life, is totally adequate to compensate the family. The attorney gets one-third and the family gets $10 million.
