ACTRESS Judy Ann Santos has filed counter charges against Internal Revenue Commissioner Guillermo Parayno Jr. and six of his men for allegedly falsifying and committing perjury when they swore on the veracity of documents showing that she allegedly had some 1.7 million pesos in tax liabilities in 2002.

Santos said that instead of owing the government, she even overpaid her taxes by 1.09 million pesos.

Santos said the Bureau of Internal Revenue's May 19 tax evasion charge against her was "absolutely falsified and grossly perjured" because the six tax examiners who looked into her records failed to consider the fact that entertainment firms that paid for her services had paid their withholding taxes.

NOW, it's Juday's turn.

Actress Judy Ann Santos yesterday filed with the Department of
Justice (DoJ) a counter-affidavit and counter-charge against the
Bureau of Internal Revenue for allegedly falsifying and committing
perjury when it swore on the veracity of documents showing that she
allegedly had some P1.7 million in tax liabilities in 2002.

In fact, Santos said, the revenue office owed her P1,095,430 in
overpaid taxes.

In a complaint she submitted to the DoJ, Santos (Judy Ann Lumagui
Santos in real life) said the case filed against her on May 19
was "absolutely falsified and grossly perjured" because the six tax
examiners who looked into her tax records failed to include the
withholding taxes the entertainment companies had deducted from her
talent fees.

"Clearly, the taxes withheld at source were deliberately and
maliciously omitted by the complainant and his witnesses in their
perjured joint-affidavit. Had complainant and his examiners been
more diligent, prudent and circumspect, they could have ascertained
the actual facts and circumstances of this tax situation," the
actress said in the complaint against Internal Revenue Commissioner
Guillermo Parayno Jr. and six of his men.

The BIR said in its complaint that Santos earned a total of P14.76
million for taxable year 2002 -- P11 million from ABS-CBN
Broadcasting Corp., P2.9 million from Viva Productions Inc., and
P815,000 from Star Cinema Productions.

The BIR, an attached agency of the Department of Finance (DoF),
said her tax liabilities amounted to P1.7 million.

But Santos, through lawyer Bonifacio A. Alentajan,
produced documents showing that the three entertainment
firms withheld some P2.8 million in taxes from the actress'
talent fees.

Thus, minus the estimated P1.7 million tax liabilities,
Santos said she was deemed to have an "overpayment" of a
little over a million in withholding taxes.

She said she had "duly paid her taxes for 2002, and even
overpaid by (P1 million), which has not been refunded by
the (BIR) until today."

On these grounds, Santos said the BIR's complaint was a
"false and perjured accusation" based on a "false and
fabricated" joint affidavit of six internal revenue examiners
who looked into her tax records

She asked the court to dismiss the DoF case against her for
lack of legal basis.

Pres. Arroyo names New BIR Commissioner / Current News

STILL Philippines President Arroyo on Monday named officers-in-charge
at the Bureau of Customs and at the Bureau of Internal Revenue. Jose
Mario Bunag was named BIR commissioner and Alexander Arevalo, customs
commissioner. Guillermo Parayno on Friday resigned as BIR
commissioner and Alberto Lina as customs chief. Parayno and Lina were
among the 10 Cabinet secretaries who resigned and called on Arroyo to
also step down.

Mrs. Arroyo said her new Cabinet will contain people "whose
commitment to the nation and the democratic principles will be beyond
doubt."

"This is a new team that will work with me to move away from
political bickering to doing what the people of the Philippines
expect their leaders to do and that is get our economy moving and
ensure the delivery of essential services such as health care,
education, and security to all parts of the country," she said.

will now be dealing with a new B.I.R. person. Unlike the last one
who resigned this guy been with the B.I.R. much longer and
seems to know more than any other manager.

Aquino repeats call for Philippine President Arroyo to resign

There was Aquino, who clearly sees herself as the country's moral
compass following the death of Cardinal Jaime Sin, telling a packed
church after Mass that she had to speak up _ for the second time _ to
urge Arroyo to make the "supreme sacrifice" and step down for the
sake of the country over vote-rigging allegations.

The animosity appears to have been sparked when Aquino went to the
presidential palace last Thursday night to advise Arroyo privately _
and as a friend _ that it was time to go. Unconfirmed reports say
Arroyo reacted angrily, which would be in character for the take-no-
prisoners leader known for her quick temper and vows to "crush"
opponents.

Aquino went public Friday, saying Arroyo should go for the sake of
the nation because her ability to lead had been fatally weakened by
the loss of public trust.

Three hours later, Arroyo fired back at Aquino and 10 Cabinet members
who abandoned her earlier in the day, adding to the chorus for her to
resign. "I say that their actions cause deep and grievous harm to
the nation because they undermine our democratic principles and the
very foundation of our constitution," Arroyo said.

Aquino said Monday that she admired the Cabinet defectors for taking
a tough stand. "We need more Filipinos like them," she said. "They
believe their duty was to us, the Filipino people."

Tiglao shot back: "We respect the former president. She is considered
a heroine of democracy. But nobody, I think, would have a monopoly of
truth at this moment."

Philippine Senate president claims Arroyo was aware but did nothing

Senate President Franklin Drilon, who has cut ties with President
Gloria Macapagal Arroyo, said Monday he warned her of alleged
irregularities in a major Chinese-funded railway project and other
government deals, but that she did nothing to stop corruption. He
also said he informed her of massive corruption at the Bureau of
Customs, but claimed she did nothing to stop the irregularities.

Actress Judy Ann Santos said Wednesday she is not bent on forging a
compromise deal with the Bureau of Internal Revenue to settle her tax
case.

More than anything, Santos said she wanted the Bureau to clear her of
the tax evader tag.

"I want my name cleared, otherwise, I would forever bear the tag of a
tax evader. I am not," a more defiant Santos told reporters.

It was a different Santos that faced the BIR on Wednesday, far from
the emotional actress when she first visited then commissioner
Guillermo Parayno weeks ago to inquire about her tax case.

Santos, accompanied by her lawyer, met anew with BIR officials after
learning that the agency has slapped her with the additional tax
evasion cases.

The BIR said Santos failed to declare her P1.5-million income from
endorsing a sardines brand and her P100,000 talent fee from Regal
Films.

Santos’s lawyer slammed the agency for using confusing data in
charging the actress with tax evasion.

Last month, Santos filed counter charges against the BIR and its
officials for allegedly falsifying and committing perjury when they
attested on the veracity of documents showing she had P1.7 million in
tax liabilities. Instead of owing the government, Santos had said she
even overpaid her taxes by P1.09 million.

Santos said she filed the a counter charge because she wanted the BIR
to clear her name, but was dismayed when the officials did nothing
about her case.

CHARO Santos-Concio, ABS-CBN executive vice president for
Entertainment, reprimanded the staff of “The Buzz” for
airing live an interview with controversial actress
Rosanna Roces last Sunday, according to sources.

Santos-Concio reportedly felt the interview should have been taped to
control the content, in which Roces accused Jolo Revilla, son of Sen.
Bong Revilla of beating up the actress’ daughter, Grace Adriano.

The controversial interview was conducted by Kris Aquino, Boy Abunda
and Cristy Fermin, main hosts of “The Buzz.”

Roces accused her former manager Lolit Solis and former best friend,
cosmetic surgeon Vicki Belo, of spreading lies against Grace.
Roces repeatedly denied her daughter’s condition, but eventually
admitted late last year that Grace was indeed pregnant by Jolo.

The fight between Roces and Belo triggered a libel case filed by
the doctor against the actress, who allegedly referred to Belo
in various media interviews as a mere aerobics instructor. The
parties were supposed to meet in court last week to discuss an
out of court settlement, but Roces failed to show up.

ABS-CBN issued this official statement on Tuesday:

“[The network] recognizes its responsibility to its audiences
and adheres to the accepted Kapisanan ng mga Brodkasters (KBP)
industry standards of fair play and public decency in all
its broadcasts. Even prior to MTRCB’s calling the network’s
attention [to] Ms Rosanna Roces’ interview on ‘The Buzz,’
ABS-CBN [had] already taken [it] upon itself to impose
self-regulatory measures and practice self-censorship
among its talents and programs. As per agreement with MTRCB,
Ms Roces’ future interviews with the Network will
henceforth be pre-taped.”

Lawyer Ernesto C. Perez II meanwhile sent a letter to media
organizations appealing for a consideration of the rights of
Jolo and Grace as “minor children. ”

As Jolo’s counsel, Perez cited Republic Act No. 7610,
otherwise known as “Special Protection of Children Against
Abuse, Exploitation and Discrimination Act,” which provides
that “the best interests of children shall be the paramount
consideration in all actions concerning them.”

Perez said the continued mention of the names of Jolo and
Grace and “the current situation” in media reports have
“ripened into psychological abuse that have affected
both minors.”

‘Juday’ wants tax raps dismissed

Movie and television star Judy Anne Santos asked the Department of Justice (DOJ) yesterday to dismiss the tax evasion case which the Bureau of Internal Revenue (BIR) filed against her last May 18.

In a 14-page rejoinder, "Juday," as Santos is known in showbiz, also asked the DOJ to immediately file in court the graft and perjury charges she had earlier filed against former internal revenue commissioner Guillermo Parayno, and BIR examiners Roderick Abad, Stimson Cureg, Vilma Caronan, Rhodora de los Reyes and Teodora Purino.

Bonifacio Alentajan, Santos’ lawyer, said the five BIR examiners led by Abad came out with new and "unauthorized accusations" in their reply-affidavit and supplemental complaint-affidavit that Juday’s "additional undeclared income" from Century Canning Corp. and Regal Entertainment, Inc. had brought her total income for 2002 to P16,396,234.70, and her undeclared income to P8,362,902.

"The preceding only proves beyond reasonable doubt that their original joint affidavit, upon which the complaint of Parayno was based, is absolutely false and perjured, because it specifically alleged the undeclared income in the amount of only P6,762,902," he said.

Alentajan said it is fundamental in all criminal prosecutions that the accused shall enjoy the constitutional right to be informed of the nature and cause of accusations against him.

"Every material fact and essential ingredient of the offense, every essential element of the offense, must be alleged with precision and certainty," he said.

"Such description of the particular act alleged to have been committed by the accused must be sufficiently full and complete that will enable him to properly defend himself against the accusation, and to accord him his constitutional right to due process," Alentajan said.

He said changing and adding new causes of action and accusations in the supplemental complaint would "grossly violate" the constitutional right to due process of the accused.

"This is aggravated by the lack of authority from the commissioner of internal revenue who has the sole power to do so," he said.

"The inveracity and falsity of complainant’s accusations are judicially admitted by the five BIR examiners when they stated in their reply-affidavit, under oath, that to reiterate, the estimated tax liability of P1,718,925.52 stated in the (BIR’s) joint affidavit referred only to the deficiency income tax for (Santos’) undeclared income," Alentajan said.

He added that according to the BIR examiners, "said amount of P1,718,925.52" had already "taken into account" all taxes withheld from Juday’s income.

"How do they arrive at the amount of P3,710,319.32 as the income tax due?" Alentajan asked.

"The complaint and joint affidavit contained no explanation. It must be noted that the preceding computation did not allow any cost, expense, or deduction from the alleged undeclared income.

"This is imperative because income tax is imposable only on the net income of self-employed. The (BIR examiners) further alleged that they omitted the presentation of the above mathematical computations on the assumption that respondent and her esteemed counsel would readily and easily understand the simple and clear allegations in our joint affidavit, as any reasonable person would undoubtedly so understand," Alentajan said.

He said the charges against Santos in the BIR examiners’ affidavit-complaint and supplemental affidavit indicate that they have "desperately resorted" to perjury.

"The foregoing adulterated and unauthorized accusations are merely based on erroneous presumptions, but they are not evidence of anything," he said.

"What the five BIR examiners have is merely an estimated tax liability. There is no report of the investigation conducted. No working paper accomplished by the examiners. No audit report. Nothing whatsoever.

"There is no actual assessment nor a final notice and demand for the payment thereof served upon respondent as required," Alentajan said.

He said the BIR hastily filed the tax evasion complaint against Santos while the investigation of her tax compliance records was still going on.

"Why this precipitate and hasty filing of a conjectural criminal complaint purely based on hearsay?" he asked.

"And with massive tri-media coverage," he added, "Commissioner Parayno should have given the respondent ample opportunity to explain her side, and rectify her mistakes, if there were any.

"If deficiency is correctly ascertained, then he has the duty to collect it. Instead, Ex-Commissioner Parayno opted to be highhanded and oppressive.

"Without doubt, harassment and manifest partiality are evident, and due process of law clearly denied. In the light of all the foregoing, it cannot be said that respondent attempted to willfully evade the payment of her income taxes," Alentajan said, even as he denied that Santos had willfully avoided paying taxes, as the BIR had alleged.

"There is no allegation nor proof presented that respondent Judy Anne Lumagui Santos knowingly and willfully filed a fraudulent return with intent to evade and defeat part or all her taxes," he said.

"Simply stated, for a criminal prosecution to proceed before assessment, there must be a prima facie showing of a willful attempt to evade payment of all or part of the income taxes. In the instant proceeding, such circumstance is inexistent," Alentajan said.

Meanwhile, Santos said Parayno’s resignation as BIR commissioner indicates he is no longer interested in pursuing the case against her actress, and that the five BIR examiners cannot substitute for him in the case.

"Commissioner Parayno failed to submit his reply affidavit and refute my allegations in my counter-affidavit," she said.

"Under the Internal Revenue Code, the exclusive power of the BIR commissioner to initiate and prosecute criminal actions cannot be delegated nor passed on to the five BIR examiners," Santos said.

She said the complaint of tax evasion filed against her before the DOJ was perjured and deliberately falsified by Parayno and the five BIR examiners.

They falsely accused her of tax evasion when they based their complaint on "substantial under-declaration of her income," she added.

The BIR said based on her 2002 income tax return, Juday had declared the P8,033,332.70 as income solely from ABS-CBN Broadcasting Corp.

However, initial documents gathered from BIR offices and those given by Santos’ accountant and other third parties confirmed that Santos received in 2002 income amounting to P14,796,234.70, not only from ABS-CBN, but also from other sources, the BIR added.

The BIR said Juday received from ABS-CBN income amounting to P11,055,554.70; Viva Productions, Inc. P2,925,000; Star Cinema, P815,680 or a total of P14,796,234.70.

Comparing the income declared by Juday in her 2002 income tax return amounting to P8,033,332.70, and the income the BIR has confirmed was paid to her for the same year amounting to P14,796,234.70, it is clear that Juday failed to declare P6,762,902 in income, the BIR maintained.
