They are Secretaries Florencio Abad of Education; Emilia Boncodin of Budget and Management; Cesar Purisima of Finance; Corazon Soliman of Social Welfare and Development; Rene Villa of Agrarian Reform; Juan Santos of Trade and Industry; Commissioners Guillermo Parayno of Internal Revenue and Comm. Alberto Lina of Customs; Imelda Nicolas, head of the National Anti Poverty Commission; and Teresita Quintos-Deles, Presidential Adviser on Peace Process. The President said she will announce the composition of her new Cabinet in two days and assured that the individuals she’ll choose will serve unswervingly and remain loyal to the Constitution. In the meantime, she has designated Officers-in-Charge for the vacant positions in the government, namely, Mario Relampagos for the Budget department, Ramon Bacani for the Education department, Robert Tan for the Finance department, Nasser Pangandaman for Agrarian Reform, Lualhati Pablo for Social Welfare and Development, and Thomas Aquino for Trade and Industry. Tonight gathered that owners of the country's moviehouses fear shutting down their business establishments in case the government insists on collecting from them about P1 billion worth of back taxes in value added tax (VAT). Engr. Ric Camaligan, president of the National Cinema Association of the Philippines, recently disclosed that they have raised their tax woes to the office of President Gloria Macapagal-Arroyo so their predicament would be resolved as soon as possible. The case stemmed from the tax assessments sent by the Bureau of Internal Revenue (BIR) to all moviehouses in the country, BIR former commissioner Guillermo Parayno including about 138 theaters owned by the SM shopping mall. Tonight gathered that Henry Sy's SM Cinema alone owed the BIR P.5 billion in VAT back taxes. They are disputing the amount, however. It was pointed out in the tax assessments that the nation's moviehouses owed the BIR in back taxes retroactive since 1996. But Camaligan, who is also first vice president of the SM cinema, said that there was never a law which says they are covered by the VAT. He likewise bared that they could not possibly pay the BIR the hefty sum since they have not included the VAT in the price of their movie admission fees since 1996. Moviehouses are vital venues especially for the local showbiz industry because they serve not only as avenues for showcasing Filipino artistic talents but also generate livelihood to thousands of its dependents, including movie scriptwriters, production crew, extras, and their families. Camaligan pointed out that it would allegedly be a case of double taxation since moviehouses are required to pay the necessary amusement taxes to the local government. It was learned that the Ayala cinemas and some other moviehouses were constrained to shell out multi-million worth of back taxes in VAT upon insistence of the BIR. Tonight also learned that the moviehouse owners belonging to the Metro Manila and the Greater Manila theater associations were inspired to get together via one big association so that they can make proper representations with the government through dialogue with officials of the BIR regarding their predicament. But the BIR, under then former commissioner Guillermo Parayno, insisted on collecting the VAT due from the moviehouses since 1996 reportedly upon "orders from higher ups." Presently, moviehouses are reeling from the economic slump aggravated by the oil price shock, forcing about 300 moviehouses in Metro Manila alone to close down. It was feared that admission fees could shoot up to the detriment of moviegoers, especially if the expanded value added tax (E-VAT) would be implemented after the temporary restraining order shall have been by the Supreme Court. This could further aggravate the situation of cinema owners who can no longer afford to settle the back taxes they never collected from moviegoers. The Bureau of Internal Revenue said the doctors’ positive act to cooperate with its effort to raise money for the government came barely a month after the bureau held tax briefings for medical practitioners from the Our Lady of Lourdes Hospital last June 29. According to BIR officials who refused to name the taxpayers, the doctors filed their amended returns for 2000 to 2004 last July 8. The returns reflected substantial increases in their income tax payments. The doctors also made an assurance that they would continue to support the bureau’s tax programs. COLMO DUMAGUETE CITY — A former Bureau of Internal Revenue (BIR) official has supported the plan of Negros Oriental Rep. Herminio Teves to require buyers of motor vehicles to present their income tax returns (ITRs) first before they could take their flashy cars and vans home. Lawyer Frederick Capitan, a former revenue district officer (RDO) and top official of the BIR’s tax fraud division, said that this requirement should have been imposed a long time ago were it not for the resistance by some quarters who feared that presenting ITRs to the Land Transportation Office (LTO) could expose them to undue scrutiny and invade their privacy. Teves earlier urged the LTO to also share its database with the BIR, which is the only agency empowered to collect taxes and investigate citizens who are cheating on their income taxes or circumventing the law to reduce their tax obligations. "Tax the rich. Tax those who buy cars. Many of them earn their money from dividends, money market placements and other unreported sources of income," Capitan said. "Those who earn from dividends, money market placements and others only pay a final tax. They do not even file their ITRs," he added. Capitan said those who buy cars using bank loans must have their ITRs, so the BIR must be on the lookout for them. The former BIR official said the Teves proposal is laudable and is doable. "Under the law, all forms of income, legal or illegal, are subject to tax. Those who earn incomes from activities not reported to the BIR must legitimize the same," Capitan explained. On the significant issue of high remittance fees assessed by government financial institutions (GFIs) from overseas Filipino workers (OFWs), Caoitan said "government must check whether charges slapped on OFWs cover the tax paid by banks. Remittances should not be assessed taxes since they are exempt.
