The Bureau of Internal Revenue yesterday slapped a P6.76-million tax suit against actress Judy Ann Santos for allegedly under-declaring her income for the year 2002.
BIR Commissioner Guillermo Parayno said for 2002, Santos declared in her income tax return having received talent fees amounting to around P8 million from her mother company ABS-CBN.
The filing of the tax case stemmed from the income declaration of ABS-CBN that said it paid Santos P11 million for taxable year 2002.
In addition, the BIR also got a certification from Viva Productions Inc., confirming that they paid the actress talent fees amounting to P2.3 million. Star Cinema, a sister company of ABS-CBN, also declared a payment of P815,000 to Santos.
"The income we confirmed to have been paid her by ABS-CBN and the two film production companies totaled P14.8 million. It is clear that she failed to declare in her income tax return for 2002 the amount of at least P6.76 million," Parayno said.
The undeclared amount of P6.76 million represents 84 percent of her total income, a gross violation of the tax code’s which states that underdeclaration of income of more than 30-percent constitutes prima facie evidence of false or fraudulent return.
The BIR further said that Santos’ P14.8-million income in 2002 does not include the talent fees she received from other sources, such as her endorsement for the political bid of Sen. Jamby Madrigal.
She has also done several product endorsements for 555 Sardines, Leonardo Bags, Angel evaporated milk, Fitrum, Piltel, AMA Computer Learning Center, Pacific Blue Shades, and San Miguel Beer.
Richard Gomez submitted his counter-affidavit to the Quezon City Prosecutor’s Office, according to Assistant Chief State Prosecutor Richard Anthony Fadullon.
Gomez belied allegations made by the BIR that he underdeclared his income for 2003 amounting to P100 million.
So far, the BIR has lodged tax cases against several well-known personalities, including singer Regine Velasquez and Gomez’ manager Douglas Quijano. It also filed tax evasion charges against fitness guru Cristina Aboitiz-Juan; Dr. Joel Mendez; basketball star Paul Asi Taulava; former AFP Comptroller Maj. Gen. Carlos Garcia; PT&T official Jose Luis Santiago; Francisco Motors owner Fernando Francisco; and CAP Pension president Enrique Sobrepena Jr.
