Nora Aunor wins round one of court trial in LA

Actress and singer Nora Aunor won the first round of the preliminary court trial in Los Angeles, California, Monday (Tuesday in Manila) after the judge found out that the arresting officer did not read her rights while being arrested for suspected possesion of illegal drugs.

Lawyers Claire Espina and Sherwin Edelberg told ABS-CBN's The Filipino Channel that the judge's decision was a "positive development."

Aunor's counsels said that the fact that the actress was not read her rights, or the Miranda Rights, during the arrest inside the Los Angeles International Airport supported her defense.

The Miranda warning is given by police in the United States to suspects whom they have arrested and intend to question. Miranda warnings were mandated by the 1966 US Supreme Court decision to protect a criminal suspect's Fifth Amendment right not to be subjected to coerced self-incrimination.

The lawyers also said that Aunor was not immediately provided an interpreter during the arrest on March 30.

In an interview after emerging from the court room, Aunor said the experience was traumatic, but declined to elaborate.

Aunor, Nora Cabaltera Villamayor in real life, is facing charges of illegal possession of a prohibited substance before the court. She was arrested at the LA airport for allegedly possessing eight grams of methamphetamine crystals (shabu) and a glass pipe in her luggage.

She was released after posting $10,000 bail.

Aunor pleaded innocent to illegal drug possession charges.

The prosecution has argued that the substance confiscated from Aunor was metampethamine-based.

The next hearing is scheduled next month because there is evidence to warrant a court hearing against Aunor. She, however, is not compelled to attend the hearings and her counsel can appear in her behalf.

Under California law, Aunor may be jailed up to 18 months if found guilty of illegal drug possession.

In a recent interview with GMA- 7’s Lhar Santiago, Nora Aunor expressed disappointment (and hinanakit) for President Gloria Macapagal Arroyo for the latter’s reneging her promise of financial help to her foundation.


Ms. Aunor, who’s facing drug charges in the US, vigorously campaigned for PGMA during the last presidential elections. First Gentleman Mike Arroyo facilitated the visit in Malacañang of some 700 Noranians before the campaign period and Ms. Aunor said FG promised her financial support.

"Pero awa ng Diyos, wala pang dumarating na tulong sa akin," the Superstar said. She intimated that she most needed that financial support now that she has a court case in America.

But a movie observer noted: Didn’t Nora said that she was campaigning for GMA and not for fellow actor Fernando Poe Jr. because she believed GMA was the more worthy and deserving president and that she wasn’t being paid for her services and efforts? So why is she expecting financial help now from PGMA?

Anyway, it seems that Nora also has hinanakit for ABS-CBN. In the local showbiz circle, everybody knows that the superstar was in the original line-up of "ASAP" in LA. But a few days before the show, her name wasn’t mentioned anymore in the show’s promotion.

Upon inquiry, Nora’s manager, Norie Sayo was told that for Nora to be able to perform in "ASAP" she has to have another working visa. This was when Nora’s lawyer reportedly stepped in and talked to an ABS-CBN exec who was told that Nora has an "O" visa which is given to persons of exceptional talent or ability in the arts. This visa enables holders to legally work and stay in the US.

"If I had my way, ayoko na sanang magperform kaya lang sabi ng lawyer I have to fulfill our contract." Nora revealed that this isn’t the first that she felt bad about how ABS-CBN had treated her. There was a time, when she was doing a show for the network and she was reported to have been drunk on the set that’s why she couldn’t master her dialogue and it took her six takes to do so. "That wasn’t true at all, they did not tell what really happened that’s why na Take 6 ako," Nora lamented.

She said she misses her children (she communicates with them regularly and she’s happy to know that Matet is pregnant again), and she wants to go home but she has shows to do for the rest of the year. This coming August alone, Nora has scheduled shows in LA, Las Vegas and other cities in the US. There are also offers for her to do a stage show, recording and even a movie in the US. But she told Lhar "sana GMA na lang mag-alok sa akin," she said.

About her children and her fans in Manila, "magsasama-sama rin kami ulit. Pero lahat ng ginagawa ko ngayon para sa kanila," She thanked her fans who’ve always been there to support her no matter what.

About her problems (which includes her drug case but which she couldn’t talk about on the advice of her lawyers) Nora said, "lahat naman tayo may problema pero sabi nga habang may buhay, may pag-asa. Kailangan lang lumaban tayo at huwag pagagamit. Lalaban na ako ngayon at ayoko nang pagamit!"

She’s very happy with the very warm response of her fans in the Bay Area to her and Tirso Cruz III’s recent intimate show in Vallejo produced by Cora Salumbides and Vicky Nubla.

NORA AND VI, POLES APART NOW

Heard that Nora Aunor failed to get an interpreter during
the second hearing of her drug case in Los Angeles. She felt
more abandoned when no fans also showed up to give her
that much needed moral support. Some Filipinos in the US
are pessimist by saying she has but a slim chance to get
off the hook because the U.S. airport people have
witnesses to support the allegation against her.

Meanwhile, on the very same day of the superstar's trial
in LA, the Star for All Seasons, Vilma Santos just arrived
in Manila from a second honeymoon in Europe looking
so fresh with Senator Ralph Recto, an aura of happiness
and fulfillment having a strong family ties
and financial stability.

Nora and Vilma seem to be poles apart now, but still
people try to compare them. Unending rivalry?

The trip to Los Angeles, California was supposed to have a seamless itinerary of concerts and gigs. However, it has become one of the most serious challenges that Superstar Nora Aunor has to face. Last March 30, the singer-actress was arrested at the Los Angeles International Airport for allegedly carrying eight grams of shabu in her luggage. She was then charged and is currently on trial for alleged possession of illegal drugs.

The primary question on most people’s minds is did she or didn’t she bring the illegal drugs to the US? Is son, Ian De Leon’s suspicion, that an ill-intentioned person or crazed fan slipped the drugs to Nora’s luggage as part of some sick joke, true? Or is there a silent enemy lurking behind Nora’s back who would practically do anything to bring the star bad publicity?

Nora could only turn to her fans and loved ones for support. She instantly gave her word she would never give up on them. As this isn’t the first time that the actress is at the center of a controversy, her children believe that she will survive this one as well. In previous interviews, the Superstar has said that if not for her children, she would not have been brave enough to face the trial and defend her name. Her counsels, Atty. Claire Espina and Atty. Sherwin Edelberg see to it that Nora get this optimism continuously fired up inside.

After Nora pleaded “not guilty” in last April’s arraignment, showbiz talk shows were flooded with calls asking if the Superstar’s concerts would proceed in Las Vegas and in other venues as scheduled. These concerts did push through and were even sold-out.

But come late July, during the most recent of the Superstar’s preliminary hearings, there was new tension in the air. Three witnesses who arrested the actress that fateful day of March 30 were put to the stand. Nora said the experience was “traumatizing” and spectators could attest to this feeling as the actress was seen walking in and out of the court to puff smoke. “It’s okay to be nervous,” Atty. Edelberg has told Nora.

Still, there’s hope for the actress. Her counsels said Nora might just get off the hook because of a legal technicality. There are reports that the arresting police officers failed to read Nora her rights and that they didn’t abide by her request to be assisted of a Tagalog interpreter. “They were talking to her about technical things in a language that she’s not comfortable in,” noted Atty. Espina “It’s positive in that sense. But it doesn’t mean that there will be no trial. There will be a trial certainly because she was bound over for trial, unless the case is disposed off in some other matter.” Along that positive note is the reported admission of the police officers that they indeed weren’t able to read Nora her rights and explain to her the consequences.

Nora remains free, albeit temporarily after posting a bail of $10,000. Meantime, the drama continues for the Superstar. Her next court date is scheduled on August 8 where she is expected to re-enter a plea of “not guilty.”
