Beauty surgeons of the stars face BIR raps
July 13, 2005 /By DJ Yap/ Inquirer News Service
THE TAX man cometh for beauty experts Manuel and Rosario Calayan.
The husband-and-wife team of cosmetic surgeons was charged with defying
a subpoena requiring them to submit their accounting books to the Bureau of Internal Revenue (BIR).
But their lawyer said the Calayans, who are known for their work with movie and television personalities, already fulfilled their tax dues and had submitted all the documents asked of them.
The BIR filed Wednesday a complaint against the couple before the Quezon City prosecutor for violations of Section 266 of the National Internal Revenue Code of 1997.
Four dates
According to the complaint, the tax agency requested the Calayans to present their books on Feb. 17, March 1, March 7 and April 6, but they failed.
This prompted the agency to issue a subpoena duces tecum dated May 30, which set the deadline for compliance on June 14, said BIR lawyers Mario Cruz and Jose Catindig in their joint-affidavit.
On June 10, the Calayans received the summons. The couple hold clinic at the Calayan Surgicenter at Medical Plaza in Makati City.
The Calayans requested through their lawyer Roberto Rodriguez to extend the deadline to the 17th, but the BIR lawyers said the couple never appeared to present the requested documents.
Reached by the Inquirer, Calayan counsel Maricel Pascual-Lopez, however, said her clients presented official receipts and documents on March 7, April 21, April 28 and May 27. She said the documents were stamped received by the BIR during in-house audit by the tax agency.
Nothing more to submit
She maintained that on June 17, the Calayans already complied with the subpoena and that there was nothing more to subpoena.
Failure to obey a summons is punishable by up to two years imprisonment and a fine of up to P10,000.
The Calayans host a segment on GMA 7's morning show "Unang Hirit" called "Liga ng Kagandahan" with Fanny Serrano.
Their rival, beauty doctor Vicki Belo, also hosts a beauty segment on ABS-CBN's "Magandang Umaga Bayan."
It was Manuel's liposuction procedure on former TV talk show host Rosanna Roces that catapulted him and his dermatologist wife Pie into show biz fame.
The Calayans are now endorsed by popular show biz celebrities like Angel Locsin, Pia Guanio, Sunshine Cruz, Ethel Booba and Jen Rosendahl.
