Dave, I agree that the the code requires a #8 solid copper conductor, but that rule was probably carried over from swimming pool bonding requirements. On a swimming pool the enviroment, hence clorinated water, could get between the strands of stranded conductors and cause deteriation of the conductor which is why a solid conductor is required. On a hydromassage bath tub clorinated water is not used as the water is discharged after each use, therefore I don't think the same conditions exist for a hydromasage bath tub. A code proposal may be in order.
