 僱員有權加入職工會為會員，或擔任職工會辦事人員，在適當時間參加職工會的活動，及組織工會或申請辦理工會註冊事宜。僱主或其代表人均不得阻止或遏止僱員行使這種權利，亦不得開除，處罰或歧視運用這些權利的僱員。此外，規定僱員不得加入任何職工會或須放棄其職工會員資格及活動作為受僱的一項條件，亦屬違法。
