The contract states that the person lowest in seniority gets forced, unless you are going on a day off or were forced the day before. I think only 2 Institutions follow the Contract and force the person lowest in seniority. Most Institutions run a rotating list due to previous labor management agreements. An Officer at Old Colony filed a grievance to stop the rotating list and he lost because the arbitrator said past practice shows an accepted way of doing things even if it goes against the contract. I guess Old Colony has rotated the list for years and nobody fought it. Talk to your Chief steward.
Some Officer schedule swaps to get out of being forced. They can't be forced if they did a double but they can be forced if thay are scheduled to come back later for a swap. The swap would be cancelled and have to be payed back later.
For example, C.O. JD works 7x3, he is told he is being forced on 3x11 and he says "I have to work a swap on 11x7 so I cannot be forced". Well guess what, he is supposed to be forced and then he cannot work his 11x7 swap so the 11x7 officer he is working for must be contacted to see if he can come in or wishes to use paid time for his absence. That's the way it is supposed to be done. Check the minutes od the last Union labor management meeting. It was discussed.

Re: Forced Over Time (NT)I thought the CBA superceeds mostly everything. That seems like a weak decision on behalf of the arbitrator.10:56:55 03/04/08 Tue
