MARLBOROUGH —

A city man was arrested Thursday night after police say he sexually assaulted a 13-year-old girl after driving her and several friends to a McDonald's restaurant.

Angel DeLeon, 26, of 35 McGee St., refused the girls' request to drive them home and instead pulled over on McGee Street, authorities said.

"At one point in time, the defendant stops, with the windows up and doors locked, and attempted to kiss (the girl)," Assistant District Attorney Erin Bell said during DeLeon's arraignment in Marlborough District Court. "The alleged victim pushed him off, and he continued."

DeLeon then tried to kiss the girl and unbutton her shirt, then put his hand inside her pants, according to Marlborough Police report on file at the court.

Bell asked for $10,000 cash bail, but defense attorney Natalie Corvington called the amount "extremely excessive." Corvington said DeLeon's arrest was a misunderstanding.

"The (alleged victim) asked the defendant if his gold chain was real gold," said Corvington. "She asked him to take it off, put it around her own neck, and wouldn't give it back. Then she runs away, calls police, and makes this allegation."

Corvington also said DeLeon's criminal record has no felony convictions and shows no background of sexual assaults.

"If he were the kind of person to do what is alleged, there would be some reflection of a more criminal record," she said.

Bell said authorities are concerned DeLeon may be a flight risk because he has several different aliases.

"This is an individual sophisticated enough to get seemingly valid ID cards and change his name," she said.

Corvington, however, argued the names were not aliases, but rather variations of his full name, a common occurrence in his native Guatemala.

"The four pieces of ID (police found) all reflect the same name," she said.

DeLeon is charged with one count of indecent assault and battery on a person under 14, although Bell said the investigation is open and more charges are possible.

Judge Andrew D'Angelo ordered DeLeon held on $750 cash bail, which DeLeon had not posted as of yesterday afternoon, according to court records.

His next court date is a Sept. 12 pretrial hearing.
