Fake craigslist sex ad stirs rivals

An online dispute between a local cable TV host and a Framingham couple has spiraled into a public spitting match and may spill into a courtroom before it's over.
Jim Rizoli, who hosts "Illegal Immigration Chat" on a local cable TV channel, said he will pursue any legal options he can against William Tulaba of Framingham after obscene personal ads soliciting gay sex under Rizoli's name were posted late last year on the Web site craigslist.org.
Police are investigating Tulaba's connection to the three fake personal ads that listed Rizoli's phone number, according to court documents.
Craigslist is an online forum for jobs, housing, services, personals and personal property.
As part of the investigation into the bogus online posting, police seized Tulaba's computer, which is now being examined at the state police crime lab.
One of the fake personal ads featured a picture of Jim Rizoli holding a microphone. Next to that was a photo of male genitalia next to a ruler.
Another ad was entitled "Looking for my donkey show," according to court documents. Another posting solicited sex from multiple men.
Rizoli said he began getting phone calls from people who propositioned him after seeing the craigslist ads last December.
"They would call and say 'I saw your ad,' and I'm sitting there thinking 'What the hell are you talking about?"' Rizoli said.
The attempt to smear him, Rizoli said, stems from his anti-illegal immigration stance.
Rizoli, who heads a group called Concerned Citizens and Friends of Illegal Immigration Law Enforcement with his twin brother, Joe, blasted Tulaba during a recent cable TV broadcast.
"We're against illegal immigration, " Rizoli said yesterday. "It's a hot issue around here. They can't attack you civilly, so they do this."
Meanwhile, Tulaba's wife, Ellie, while declining to comment on the Rizolis' allegations on the advice of her husband's lawyer, said Jim Rizoli and some of his associates are racists and had been harassing and intimidating her via e-mail for months because they "assumed I'm not 100 percent white."
In those e-mails, she said she was called names and referred to as "the scum of the earth."
"It's ignorance and hatred," she said. "There's a lot of that in Framingham."
She said she contacted police about the e-mails, but no charges were brought.
Ellie Tulaba, an American citizen of Brazilian descent, has lived in Framingham for 13 years. William Tulaba is also an American citizen, she said.
"His (Rizoli's) issue is not with illegal immigrants but with Brazilians," she said. "I think his show is disgusting."
Lt. Paul Shastany said the Police Department is awaiting results from the state police forensics lab on information found in the computer seized in connection with the craigslist posts.
On Feb. 4, Framingham Detective Lawrence Hendry obtained search warrants that authorized him to search connection logs held by the Microsoft Corp. and to search records of Comcast Cable Communications for subscriber and billing information of an account that had an Internet protocol address connected with the craigslist postings.
The account holders for the address were connected to Ellie and William Tulaba's apartment, according to court documents.
On March 5, a warrant was signed by acting Clerk Magistrate John De Luca, allowing police to seize any personal computer, storage media, printout of the ads and any documents indicating ownership of a computer found at the Tulabas' Auburn Street apartment.
Court documents indicate Jim Rizoli's allegations could constitute criminal harassment.
"I'm going to nail him to the wall if I can," Rizoli said.
Meanwhile, Ellie Tulaba said she and her husband have discussed with lawyers the possibility of taking Rizoli to court.
She stressed, "My husband is not being charged with anything."
Rizoli has never met William Tulaba. "I don't even know what he looks like," he said.
Rizoli has twice run for Board of Selectmen, losing both times. In 2006, he ran for the 6th Middlesex District state House seat. He also lost that race.
Susan MacTavish Best, a spokeswoman for craigslist, indicated the company is constantly trying to block illicit activity like the three posts at the center of the controversy.
She wrote in an e-mail, "Craigslist is an extremely unwise choice for those intent on committing crimes, since criminals inevitably leave an electronic trail to themselves that law enforcement officers will follow."
