Framingham immigrant custody battle continues

Continuing a two-year custody battle, a Middlesex Probate and Family Court judge awarded Richard Brita full custody of his 2-year-old son this week after the boy's mother violated their joint custody agreement.

Ieda Maria Da Silva, an illegal immigrant from Brazil, said she was unable to drop the boy off to the father at designated times because of her work schedule and because she said the boy did not want to see his father.

"Every time I dropped my child off, my child said 'I don't want to go with daddy, I don't want to go with daddy, mommy,"' said Da Silva.

On Wednesday, Judge Randy Kaplan ordered the boy turned over to the father pending a review of Da Silva's visitation rights on May 13, according to court documents provided by Da Silva.

Brita, who is known in Framingham for railing against illegal immigration, did not return several phone calls.

In an earlier order, Kaplan expressed concerns about both parents' fitness, citing mental issues on Da Silva's part and Brita's criminal record of abuse and a permanent restraining order that prevents him from contacting two children from a previous relationship.

The judgment and case file could not be obtained from the court because the case is closed to the public.

What people don't know is, the mother said she was going to kill the child! The court has given her so many chances it's hard to believe she didn't get the mental help she needed to help her cope. Right now she is facing jail time so that should tell you where things are headed. By the way the child loves the father, and when he would drop the child the child off the boy would kick and scream, he didn't want to go back to the mother. In fact one time the mother was caught smashing the little boy in the face because he wanted to go back to the father. The mother has abused the boy and thats why he doesn't want to go back to her. She is doing her best to make it look like Rick is the problem when in all reality she is. I feel sorry for the boy when he is with the mother, but I see him beaming when he is with his dad. The mother needs some help. Rick has not been found guilty of any of the charges that were brought against him from the first girl he was with. All the charged were frivilous, believe me if Rick was a bad father he wouldn't of got custody of the boy. Do you know how hard it is for a father to get custody? Don't believe everything you read in the MWDN, they are the last people who will get the facts straight.
