Subject: Trampling of our Freedom of speech.

Who owns the Copywrite?

On January 10th at 10 pm our CCFIILE played on local cable as usual, as it does every thursday night at 10pm

About 39 minutes into the show the screen goes black. What happened? Was there a problem with the DVD, power outage, glitch in the play back.

Next day I call the studio and asked what happened? Come to find out Steve Innis the FPAC director was told by Ron Rego one of the Board of Directors of FPAC to go down to the studio and stop the show from airing. What was in that show was so disturbing to warrant such a reaction at 10 pm that night you ask? Was there something perverse in the show, was there vulgar swearing? Were there some crude racial remarks made? None of the above! Ron Rego claimed that we were airing a piece in our show that was copywrited and didn't have his permission to play, without the consent of the copy write holder.

Are we denying that we used a 20 minute clip from the Govt. channel, heck no! I actually purchased a VHS copy of the program that Ron Rego videotaped himself in the town hall for $20.00, so that we could have a nice clean copy to use for our commentary video. Why would he give it to me if it was wrong to do so.

You see, fair use means that as long as you use the video material in a commentary or way that changes the original to something that it wasn't in the beginning it's OK. So that is just what we did. We added our own commentary to a part of the towns video, so that we could critique what was said and add our own personal opinions.

People do it all the time. In fact I watched a wrestling video that was on the cable the other night and two people were commenting of what was happening in a video from Japan.

Do you think they had the copywrite of that Japanese video? Pretty doubtful.

Is there something wrong with that? If there is, than you might as well stop Yahoo, Google, all the newspapers, and all media print with what they are doing also.

News business organizations wouldn't be able to do any commentory of stories from any other news source if that was the case. Now how boring would life be with that happening?

So the question remains, who is the real copywrite holder of said video? Is it Ron Rego who works in Media Services Dept. at the Framingham Town Hall. Hmmm, I thought that workers don't own the work they are working on if they are doing the work for a company or town. Is the Town of Framingham the copywrite holder as they are the ones who are paying Ron Rego to do the work? If Ron Rego stopped working for the Town of Framingham would he take all the videos of all the programs he videotaped from day one with him?

According to how the scenario played out, it seemed like Ron Rego was the one who thinks he owns the copywrite of the said video, that is the bone of contention now, because if he wasn't then why did he give Steve Innis the order to take the CCFIILE show off the air? Or did someone from the town of Framingham give Ron Rego the order to make Steve Innis take the CCFIILE show off the air?

Well either way you slice it, Ron Rego is guilty of trampling the Civil Rights of Jim and Joe Rizoli and cutting off their free Speech, or the Town of Framingham is?

So which one of you is going to fess up to it and put yourself into the legal battle that will now happen, if we decide to bring our case to legal counsel?

What we ask is not unreasonable. We ask that Ron Rego resign from the board of Directors of FPAC, and the Town of Framingham's appointed media advisory board, and reprove him for the damage he has done to the reputation of Jim and Joe Rizoli the producers of the CCFIILE Show.

If not, then all those involved above might find themselves in a very costly legal battle that might rival the one they are in now with SMOC, the only difference is you are the ones taking away the free speech of Jim and Joe Rizoli.
