I think if Rick does get custody she will run.
The difference here is it would be hard for her to run because she will probably have supervised visitation and that would make it very hard for her to be alone with the kid.

She could run before the court case and there would be nothing he could do about it.
If that happens she would be wanted for kidnapping
and warrants would be issued for her arrest.
She's a criminal now, and that would make her case even worse.
