At her Marlborough apartment where she lives with her 2-year-old son Richard Brita Jr., Da Silva said Rizoli knew she was an illegal immigrant when he tried to help her find work in June 2004

But things got worse after the boy's birth in April 2005. Da Silva said Brita became abusive, and one month shy of her son's first birthday, she went to the hospital, where she was diagnosed with "elbow tendonitis; domestic violence." Da Silva left Brita's house and filed a restraining order against him on March 27. The same day, Brita went to court and asked for full custody of the boy.After a hearing on April 7, the order was vacated. Da Silva filed another restraining order, and in late April, the court issued a new 10-day order, which was dismissed in May. The same month, Da Silva also asked for full and sole custody of her son.

EVEN THE JUSTICE INVOLVED SAID RICHARD BRITA IS ABUSIVE...

Justice Randy Kaplan, who is handling the custody case, said in her temporary order she is concerned about both parents' fitness. "Father has a lengthy criminal record for abuse," she wrote. "He has two children from a prior relationship and there is a permanent restraining order prohibiting him from any contact with those children. There has also been at least one violation of the restraining order."
