Dear Daniel,

First and foremost, you have to agree with me that I have been most patient and understanding for the past 2 months in my dealings with you. Nevertheless, I have to thank you for the opportunity and responsibility to accept the undertaking of building a website for me.

You missed and skipped our last 2 appointments, very disappointing.


How is the progress with the construction and designing of BGN website? (www.BGN.com.my)

As per your quotation dated:4th June 2008, payments were made out to you as follows:-
(1) Hong Leong: 187166 dd:10/6/08 Amount: RM200.00
(2) Hong Leong: 187167 dd:16/06/08 Amount: RM1000.00
(3) Hong Leong: 187168 dd:23/06/08 Amount: RM1000.00
Total: RM2200.00
Payment was paid to you as 50% payment for building of website (www.BGN.com.my)



It was most ridiculous, when we requested for 1 page of BGN's details to be set up to inform visitors that website was under construction, was not attended to! We are concerned because of this issue, rightly so when normally corporate websites could be set up within 3 days!


We feel that as responsible and ethical businessmen on your part or the part of your company and associates and partners, you should answer our questions honestly and in a straight-forward manner.

Q.(1) When can we see at least some of the finished work of www.BGN.com.my?

Q.(2) When will website www.BGN.com.my be finally completed, functioning and ready to do enrollment of members?

Q.(3) When are we able to meet up to discuss and resolve whatever problems that you may be facing?

The 1st. email was sent on the 15th August 2008 Friday. After 24 hours, the 2nd. email was sent on the next day Saturday 16th August 2008. The 3rd. email was sent on the 19th August 2008 Tuesday. All the 3 emails, of which the contents are the same, were attentioned to Daniel Oon Swee Lee, emailed to the following email addresses:-
(i) oon_7@yahoo.com (ii) epower2u@yahoo.com (iii) ezbizlink@yahoo.com


With reference to the letter sent by Registered Post on the 19th August 2008, after 7 days we have yet to hear from you, still no reply at all, Mr. Daniel Oon Swee Lee. There was not any attempts on your part, to try to contact me to meet-up to discuss and to resolve the matter amicably. We understand you could be having a very busy schedule, but that does not mean we are any less important as your first time customer.

Earlier before the letter on the 19th August 2008, countless SMS's and phonecalls went unheeded and unanswered, although the few times you answered, you gave the assurance that all was well and fine and managed to convinced me to be patient and not to worry.

RULE #1. PLEASE DO NOT IGNORE a customer's complaint because of the trust and responsibility that you have been entrusted to do the job of building the website - (www.BGN.com.my)
RULE #2. RESPONSIBILITY - The ability to response or response ability should be every businessmen's guideline to success.


I, Brian Yap, hereby DEMAND that you, Daniel Oon Swee Lee, H/P: 019-227 1737 , 016-210 5771 Tel/Fax: 03-4295 2271, residential address at, R2-2-2, Pandan Puteri Apartment, Jalan 6/10, Pandan Indah 55100 Kuala Lumpur, MUST be responsible and commited to take more efforts to initiate a pro-active approach to meet-up to discuss the following:-

(i) What is the progress of the construction and designing of the website (www.BGN.com.my) ?
(ii) When will the website (www.BGN.com.my ) be finally completed and WHEN EXACTLY is the delivery date?

The MEETING MUST be held between 4th - 11th September 2008 or earlier if possible.


Needless to say, on the 12th September 2008, from this point onwards, I, Brian Yap, DEMAND a FULL REFUND from you, Daniel Oon Swee Lee, of residential address at, R2-2-2, Pandan Puteri Apartment, Jalan 6/10, Pandan Indah 55100 Kuala Lumpur,

the sum of RM2,200.00 (Ringgit Malaysia: Two Thousand Two Hundred only). All related properties and possessions of Brian Yap, given to you for the building of website (www.BGN.com.my) , such as Laminated Documents (150-200pcs.) , manuscripts for e-Book TELME - Italian Job ala Malaysia! , 3pcs.x VCD's , 1pc. t-shirt, 1pc. pen, 1pc. tie-pin, etc., documents in briefcase, 2pcs.x Telme catalogue Files, etc.


In 7 days time, (12th - 19th September 2008) , if I still do not get back all my possessions plus the RM2,200.00 , I, Brian Yap, will take the fullest action against you, Daniel Oon Swee Lee, to recover my rightful compensation.

Failing which, on the 22nd September 2008 Monday, I have no choice but to REPORT to the relevent AUTHORITIES concerned.
