AB3146 NOTICE OF SHERIFF'S SALE OF REAL PROPERTY Execution in Foreclosure On the 30, day of December, 2010, at the hour of 10 o'clock A.M. and 10:15 o'clock A.M., Pacific Standard Time, respectively, at the lobby of the Clatsop County Courthouse, in the City of Astoria, Oregon, I will sell in successive proceedings at public oral auction to the highest bidder for cash the following described real properties, subject to redemption, located in Clatsop County, Oregon, to-wit: In satisfaction of judgment entered on September 24, 2010 for costs, disbursements, attorney's fees, and receivership expenses, and in satisfaction of the liens created by the trust deeds recorded on March 9, 2007 as instrument number 200702403, and on March 19, 2007 as instrument number 200702741, respectively, the Clatsop County Sheriff is directed to sell all defendants' interests which they, or any one of them, had on or after the above referenced dates in the property more particularly described as follows: The tidelands fronting and abutting Block 5, in the Town (now City) of Astoria as laid out and recorded by John McClure, known as Tax Lot 600 together with all and singular the tenements, hereditaments and appurtenances and all other rights thereunto belonging or in anywise now or hereafter pertaining, and the rents, issues and profits thereof and all fixtures now or hereafter attached to or used in connection with said real estate. Fee title to the "tidelands" referenced above is held by the State of Oregon and will not be sold at auction. Defendants' interest in the property consists principally of a long-term leasehold interest from the State of Oregon and all related leasehold improvements on the property. The property is located at, and commonly known as, "1 Sixth Street" in Astoria Oregon (aka "The Cannery Cafe" building and related improvements). and, In satisfaction of judgment entered on September 24, 2010 for costs, disbursements, attorney's fees, and receivership expenses, and in satisfaction of the liens created by the trust deed recorded on May 2, 2007 as instrument number 200704450, the Clatsop County Sheriff is directed to sell all defendants' interests which they, or any one of them, had on or after the above referenced date in the property more particularly described as follows: Lots 1,2,3, and the North 50 feet Lot 4, Block 6, in the Town (now City) of Astoria as laid out and recorded by John McClure; ALSO the tidelands fronting and abutting Blocks 5 & 6, in the Town (now City) of Astoria as laid out and recorded by John McClure, EXCLUDING any portion of subject property below the high water line of the Columbia River, in the City of Astoria, Clatsop County, Oregon together with all and singular the tenements, hereditaments and appurtenances and all other rights thereunto belonging or in anywise now or hereafter appertaining, and the rents, issues and profits thereof and all fixtures now or hereafter attached to or used in connection with said real estate. Fee title to the "tidelands" referenced above is held by the State of Oregon and will not be sold at auction. In addition to defendants' fee title interest in lots 1, 2 and 3 referenced above, defendants' interest in the "tidelands" property consists principally of a long-term leasehold interest and all related leasehold improvements on the property located at, and commonly known as, "10 Sixth Street" in Astoria Oregon (i.e., the 10 Sixth Street office building and associated parking lot and related improvements). Said sale is made under an Amended Writ of Execution in Foreclosure issued out of the Circuit Court of the State of Oregon for the County of Clatsop, case no. 10-2073, to me directed in the case of Eric W. Jacobsen, Plaintiff, v. NO 10. SIXTH STREET, LTD., An Oregon corporation; RIVER PARK LANDINGS, LLC, an Oregon limited liability company; and ELLIOTT RENOVATION LLC, dba HOTEL ELLIOTT, an Oregon limited liability company, Defendants. Amended Writ of Execution dated the 12th day of November, 2010.
