Road Access To Lots In Section 15 -- Marvin Hardy (Bewilderd), 00:13:25 02/16/14 Sun [1]

Can someone please tell me, Why after at least 47 years of paying maintenance fees the roads are virtually NOT there. However, the other sections have paved roads or a solid road
base. An increase in maintenance fees a couple of years back were supposed to be for road maintenance. What happened here? Are the funds being used for other things other than maintaining roads, street signs, etc. Good Roads should have been laid down first, before the waterlines were installed.

We plan to clear our lot to prepare for water/electricity/culverts to be installed on November 25th. When we were in Downey's on 9/4/11 it looks like the street has been allowed to grow over and no longer can be used. I would like to use this lot . Its in section 14, lot 104. I would have thought HOA dues would have also been used to re rock roads. I notice where people live the roads are maintained. How can I get access to my property by November 25th?

Sargent Branch Library -- P R Stark, 12:49:30 10/31/13 Thu [1]

I've been a frequent visitor to the Sargent Library and every time we get a heavy rain ( like today 10-31-13 ) the building enterance and north wall are flooded with water. The water is getting in at the enterance door and the problem has been reported many time with very little response. An appropriate contractor should be sent to assess the problem and present a bid. We'll worry about the cost when the bid is in...... that's reasonable, don't you think??

Bobby, start by getting an electric pole permit from Lisa Krobot ( flood plain manager in Bay City ). She will require an Elevation certificate from a licensed surveyer. You then present your permit to Jackson Electric also in Bay City ( VanVleck ). They will offer you several option ie: 100 amp, 150 amp or 200 amp. Depending on your selection, the cost will be between $800 to $1200. Jackson will build the pole, install the pole and hook pole to line at street. You can then hire an electrician to install breakers and pull down your lines. If you follow this path you will avoid alot of headaches and and stay in the good graces with the county ( not have to pull the pole out ).

Can anybody tell me how deep the water is under the first bridge as you turn on to Carancahua Street from FM 457? I'm considering building on that canal and was told that so many oysters have attached themselves to the bridge foundation that boat passage was becoming difficult. I just wondering just how much clearance there is from side to side and how much draft on a boat is possible. Also if anyone knows, how high is the bridge from the water at high tide?

Any help would be appreciated.

Sorry for any confusion. Section 20 is across Intracoastal Drive. The area I am referencing is still between lots 59 and 60, but the section is actually no. 17.

There are maps in the Downeys offices. The only time there is someone there is at 6:00 PM the last Saturday of each month. There is a map in the Sargent Library. You can also purchase a map from the Matagorda County Appraisal District.

We have three lots on Dolphon Way and are wanting to build a boat house. The deed restrictions read 6' into canal. It looks like nearly nobody builds into the canal only 6'. Would we have a law suit on our hands if we were to copy some of the other property owners and build out further. We have a 21' pontoon boat. Want to obey the restrictions, but 6'.

URGENT!! It has come to my attention that there is a movement to dissolve the HOA. This happens when the county paves new roads. The homeowners on the paved roads decide they don't need to pay the, now get this, the $12 annual fee!! Of course the biggest losers will be all of us who own land on the dirt roads. We will have no way of maintaning the roads or parks!! Step up and let your position be heard. If you want to enjoy your land then we need access to them. All those years we paid will just go bye-bye because of the fortunate few who no longer want to pay their part. Please let the board know now. I understand that the parties who want to dissolve the HOA are seeking legal help this week.

I know they do a beach clean up twice a year but seem to me they only pick up in the public beach area.
The wife and I would like to pick up trash on the weekend from the cut to the wildlife refugee, the trash would be bagged (bags will be provided by me) and I will transport it to a drop off location. What I need to know is who I can talk to to find out where I can legally drop off the trash bags and other item picked up

Does anybody need or can use 350 gallon totes for storing water during storms or for collecting rain water. They are free. My company throws them away. I triple rinse them before I bring them home. I have one set up for collecting ac condensation and after 5-7 days I have about 300 gallons of water I use to water my lawn. Several folks down here have gotten some from me already. I get anywhere from 4-6 of them a month and sometimes more. They are first come first serve so be patient if I don't have one when you call. Bumped into Perry Johnson last week while I working at the lot. He was doing a great job filling in the holes. Best I have seen the roads in at least 2 years!!

Who in the heck owns the lot to the left (east) of i am (Lot. 52 Blk. 12)?

The lot I'm talking about has really tall palm trees across the front, a bunch of rubbish in the lot. The worst part is the darn brier bushes are so big they've turned into trees with about 6" diameter trunks. I can not cut the grass on my lot along that property line because the brier tree are right on the property line and branches hang over to my side.

If you've ever run into one of those branches while riding mower tractor you'll know what my arm looks like.

I'm not looking to get into it with the owner, just want to let him know he will be missing out on the fun!!!! He can either let me cut down the brier trees or I can send him my doctor bill.

Also I cut the grass (weeds) this past weekend but couldn't do the sloped areas at the ditch or the big slope down to canal (too steep). Can yall cut those for me with your bush-hog? After that I'll maintain it.

I'm Lot 52 Blk. 12 on Gulfview I don't think we ever had an address.

Cross over the bridge, make a right, about 1 mile is a nice park with plenty of room for the kids to crab. Also you might want to try the park on Gulfview. Good Luck

There is a concrete boat ramp at the West intercoastal end of the canal that runs parralel to Carankawa and Gulf View. It has been in disrepair for a number of years. Would the board look into making it useful again?

Hello, I am not sure where to begin. My grandfather has had property in Downey Creek since the late 70's. He has not paid the taxes and has since past. I have spoke with Matagorda county Tax collection and will be sending in the current years Taxes and 1/3 of the current tax bill and subsequently setting up a payment plan to become current on this property.

Our property is locatin in Section 15 lot 601

We are wanting to find out about what needs to be done about getting access to our property setting up water sewer and electricity. We currently only need a saw pole and water and of course road access.

If someone could help us in this matter it would greatly be appreciated.

I saw a message where someone was saying thanks for the spraying of mosquitos. We were really happy that the mosquitoes weren't as bad during our last visit to Sargent. The visit before ended abruptly because we just couldn't stand the swarm. Is the association doing the spraying? If so, how often?

Downeys Caney Creek Club Lot Owners Association has joined the Sargent Area Mosquito Controll organization. They spray as often as needed. In the first quarter of this year they have sprayed 12 times.

legal description for Sec7 Lot 126 -- Gaynell (Eugene F) Brown, 14:11:27 01/23/12 Mon [1]

I am trying to get a legal description for Sec7 Lot 126 so that the deed can be transferred into my name since my husband passed away. I am only getting arun around from the county clerk. We have paid taxes and your association dues every year.

If you can help, I would apprieciate it greatly.

Glad to see that the meeting minutes are caught up on the web site. I think that the current board is making a great effort to get things caught up and back on track. Having been part of a HOA before I know there are trying times. The best is all we can ask of these folks. It is good when the community gets behind the board and works together to find solutions to common problems.

Sargent is looking very nice! Lets all pitch in and keep the trash picked up in the ditches and roadsides. No need to live in unclean dirty areas when it is easily cleaned up to look presentable to our neighbors and friends.

I was in Downey's today 9/4/11 trying to find my parents lot they gave me. Its in section 14, lot 104. It looks like the street has been allowed to grow over and no longer can be used. I would like to use this lot . My parents bought it when I was a kid in 1966. Have paid dues all these years and now there is no access. I would have thought HOA dues would have also been used to re rock roads. I notice where people live the roads are maintained.
My parents and now I pay the same dues. How can I get access to my property?

First of all, I apologize for not answering your post sooner. Because of limited funds & time, we (Downey's) maintain the roads where people live, whether full-time or week-ends. If you intend to find your property & start coming down to enjoy the fishing, etc., we will be more than happy to see what we can do on your road. It appears that your property is on Tarpon Rd. At this time we are taking bids for shredding of the roadsides & ditches in that area. Please let us know when you will be back in Sargent & we'll try to get your property accessible. thanks!

Dear Board Members,

I am in agreement with Mr. Farrar's suggestion to take off the table for a vote at this time and put a package together. The voters need a lot more info to make a fair decision on something of this importance.

Mr. Farrar's post has made me more aware and concern about this item on the ballot. I now know more about Downey's Caney Creek.

I have been a lot owner since 1979 and I believe the board members should address the issues Mr. Farrar has stated.

Permission to sell land. -- James A. Farrar (Oh What a Blessing), 18:55:16 06/29/11 Wed [1]

Dear Board Members,

I received the Annual Newsletter and Ballot on Monday. You've done well and it was quite an achievement to get it out. Yours has the makings of one of the better Boards. In going over the newsletter and the ballot I have some issues that I'm not able to resolve dealing with the permission to sell land owned by DCCCLOA. It has to do with details for the sale and the use of the monies from the sales. It appears Owners have no say in the terms of the sale, monitoring of the sale and where the monies are to be allocated. It gives a crate blanch to the Board to be our representative and just do the best thing. As the architect Mies van der Rohe once said �the devil is in the details.� Some of the issues I have about giving permission is several-fold and you have covered a couple in the monthly meetings. This is my list but out of 2,600 lot owners I'm sure there are a bunch more.

1.0 There are 20 lots mentioned. The Club pays $3,600/yr. in property taxes.
2.0 Where are the lots? What is the value carried by MCAD for each property at what value.
3.0 On an average at $3,600/X=$3.00/$100valuation or roughly $120,000 property valuation on 20 properties.
4.0 Then the average on the properties is $120,000/20properties is $6,000 average value each property.
5.0 This has been previously discussed but how is DCCCLOA going to justify the sale at the present time if we are to pay income taxes on the profit being a gift to the association by Downey?
6.0 To sell the properties will probably require the services of a surveyor not only to lay them out but to find dedicated easements and set asides. Surveying services, legal services and the like need to be considered when selling the properties as you are aware.
7.0 Then there is the legal issue of mineral rights. Did Downey keep the mineral rights. I think he did. I believe Downey kept them and in the mid 80's a drilling firm came in and drilled for oil across on Dolphin a few lots east of Tommy Risinger's building. They capped it and went away. As I remember they were going to drill three but only drilled one. At the time the property of Section 20 was owned by John Anderson bought at a tax sale in maybe 1983.
8.0 I would think the Board Members and their families would not be allowed to purchase any of the properties due to it being perceived a conflict of interest. To allow Board Members to do so will be seen as the proverbial underhanded land deals going down with homeowner associations and local government. This ought to have been stated to that effect when asking association members to vote on giving the Board permission to sell the unidentified land.
9.0 Wetlands is a whole nother issue and does come into play but should be addressed for it can negate the value of the land and if so why are there property taxes being charged on worthless land. Joe Reiss had/has (?) 21 acres considered in the wetlands on Old Caney Creek. He cannot develop it without going through and mitigation process and providing dedicated acceptable land elsewhere for a trade at as I remember on a 5/1 ratio. In other words he would need buy and dedicate 5 X 21 acres = 105 acres of acceptable land to US Fish and Wildlife before he could develop the 21 acres. Are our lots effected? Probably some if they have not been mowed to remove the weeds that define a wetland.
10.0 The vote calls for permission to sell land. Therefore it is assumed the sale of the clubhouse and property is not included in the permission given. Is that correct? It needs to be clarified or is the Board going to somehow just include it without identifying it. I'm sure a lot of the association members are going to have the same question.
11.0 How is the sale of the land going to be handled? I would think in order for there not to be perceived collusion on the sale that someone independently would be used to handle the sales whether by realtor or auctioneer. Association members should be fully informed of the sale by a special newsletter in order that all members regardless of their status be fully informed of the sale, the properties, the terms and the time of the auction or the realtor who will be handling the sale all well in advance of any sale. If sold at auction it may not bring the money the property is worth. Then they might be handled in staggered phases and methods.
12.0 Then there is the question of where the money is to go from the sales and for what purposes. Members need to know in detail where the money is intended to be spent. What is the game plan? Are part-timers to pay for the comfort and convenience of the full-timers? There's been a good bit of that in the past. Just asking as any lot owner should. The sale of this property might bring $100,000 on the low end and maybe $400,000 on the high end. This along with more people paying back dues may reap quiet a bit of income that can be blown on activities and projects where some just want their name labeled to the project verses what's best for the whole. You could spend $500,000 on the 21 miles of roads and only pave may 25%. There needs to be in place a game plan for now, 6 months from now, 2 years out and 10 years out especially dealing with drainage and the canals. What makes Downey's? It's not the roads. Roads are for development and building commerce for the full-timers. It's the water and water means canals for the part-timers and full-timers. Canals taken back to their original depths of about eight feet will hold twice as many fish or more and make them cleaner handling more drainage. So it is roads and canals and the main park and that's about it. The park ought to have a progressive development plan for uses and amenities. There needs to be a detailed plan available to lot owners for the direction the association is headed. Future Boards will have a road map to follow. Past Board Members ought to be there for new members and not have to go through the age old learning process. After all we are all here to help one another and not to worry about credits.

These 20 lots were also set asides for various purposes which Downey called Reserve Lots meaning they were reserved for lot owners use. Some of those purposes included parks, break throughs for canals and just reserved to be defined by lot owners someday. Some of these set asides are there for dry land lot owners to have access to canals for their families. What is a park anyway but a place where the community can congregate on common ground. All you need to do is provide grass mowed once-in-a-while and maybe a light. Once the Association divests itself of these properties we will never have the money to buy another. Again it's all planning and doesn't compute very well to looking purely for a good looking accounting bottom line. If designated lots are identified and lot owners know they are there for them they might adopt them, mow and keep them up. Divestiture of them is like throwing the baby out with the wash. Some might be sold maybe all but there ought to be a plan and lot owners agree.

I'd suggest you take this off the table for a vote at this time and put a package together for the lot owners to have a detailed understanding make an intelligent decision on how the only liquid investment we have will be used for everyone's benefit.

Maintenance Fee -- David Barker, 16:30:49 06/29/11 Wed [1]

I recierved a bill today for the yearly maintenance fees.
I have paid the dues already this year, invoice # 1112. The check number was 7517, i sent it on 4-6-11. It cleared the bank a few days later.

Please advise.

The invoices that were sent out in March for the 2010 dues, were sent out late. They should have gone out in July of 2010.
We have just sent out the invoices for the 2011 dues.
