I'm not sure on whether or not the song would have been out of copyright, but I wouldn't think so. Fred Heath (Johnny Kidd) was killed in an auto accident in 1966, so I'm not sure who owns the rights to it now. All they'd have to do is pay the royalties for it's use to whoever owns the rights.

Copyright wasn't the issue with the ad. It was more my Dad (and me to an extent) were disappointed that Normie would have done an ad like that, and of course having had a hit with "Shakin'" it would have been a natural choice to use it. Thankfully it's been a few years since it has aired, so it's been fairly well forgotten by most people.
