Because the lower level seats were given out the last time the NCAA's came to Albany, some of the fans had a "reasonable" expectation of getting the same seats again, and therefore would not have asked.

In my opinion, the Pepsi had to have known that's where the seats were going to be, and therefore had a duty to be up front about this before collecting the non refundable $120.
