Well that progressive liberal Judge Gorsuch wrote the Alston decision and that other progressive liberal Judge Kavanough wrote the concurring opinion.

Well as a criminologist who has taught in the area of constitutional law and the federal courts, I can tell you that unfortunately the effects of politics on Supreme Court justices takes many twists and turns; and sometimes those decisions are manifested in antithetical ways. Look at Justice Robert ! He has often voted along side of the liberal judges on the Court. The fact remains that six of those justices are of the Republican persuasion , some less conservative than others.
In addition, they each are free to follow the parameters of the law as they see it understand the auspices of the Constitution.
