Subject: The Potential Harm to Plaintiffs in Trademark Lawsuits

I found a parallel to the Community of Christ(TM) / Restoration Branch lawsuit over the trademark to the RLDS(TM) name. A small local bottler was making Dr. Pepper(TM) using the old cane sugar sweetening formula that Dr. Pepper(TM) abandoned decades ago in favor of high fructose corn syrup, and calling it Dublin "Dr. Pepper."(TM)

There have been scientific studies suggesting that the corn derivative is connected with Alzheimer's and with the development of insulin resistance in human tissue, so bottling and selling the real Dr. Pepper(TM) might be a good idea. I certainly don't know why the substitution was made unless it was profit-related.

Profits for Dr. Pepper(TM) may be about to take a nosedive, though, since outraged Americans have started a movement to boycott all Dr. Pepper(TM) products. And, like the Community of Christ(TM) "denominational executives," the management of Dr. Pepper is probably sitting around saying, "Why are all these mad, crazy people out to get us?' It's called clueless.

But according to Loren Steffy's article, Dr. Pepper(TM) said, "We tried for years to resolve our differences with them. They continued to violate our agreement. It wasn't an easy decision." As it turns out, it may have been the wrong one.

But I have no problem comparing the Community of Christ(TM) with a for-profit corporation. Both are run as secular corporations. When a secular corporation decides to do something, it doesn't care what the Bible says about it. And it looks to me that the Community of Christ(TM) doesn't much care, either.

The name "Dr. Pepper" is a trademark of the bottling company by the same name.

Although there is a movie called "Clueless," the ordinary uncapitalized English word is in the public domain.
