According to the New York Post, the character of Tony Almeida was never in danger of leaving the series.

A few excerpts:

"I was always told there were going to be changes, but that I was always going to be coming back," actor Carlos Bernard told The Post, as he prepares to start production on the fourth season of "24" next week. "We had discussions about how the Almeida character was going to be brought back. I wanted to do another season, if the character was put in a new place."

...

Bernard's mum on the fate of Almeida's wife, Michelle (Reiko Aylesworth), or even what episode he makes his entrance, saying that kind of advance information migth spoil things for viewers.

Also, according to TVGuide.com:

Carlos Bernard has finalized a deal to return to Fox's 24 during February sweeps. (The show's new season premieres in January.) When last seen, Bernard's character — CTU chief Tony Almeida — was being carted off to prison after committing treason. The fate of Almeida's wife, played by Reiko Aylesworth, remains up in the air.

Fantastic! I suppose there is no way for him to be in every episode considering he'll probably be starting the season in prison (or at least fired), but I was afraid we'd never see him again. Now if we can just get word that Michelle will be back. Because after all, what is Tony without Michelle?
