Conflict Of Interest

It is with great concern that the situation here in Metlakatla is dire and in need of your immediate action.
Ten of the twelve council members are Metlakatla Indian Community employees. This is cause for an extreme conflict of interest as the members of Metlakatla are left with no remedy.
The newly elected mayor is left with the tenable situation were he is not able to function as supervisor to these people who are also on council and who can take action to remove him from office.
As an example: the director of Grants and contracts is under the direct supervision and authority of the Mayor and yet holds the vote to remove this mayor from office.
Not only is this a direct conflict of interest and it goes against MIC policies and regulations as listed below.
If any vote is made to remove this mayor by any of the council members it may lead to their dismissal as employee. If any of the council members who votes to remove the mayor is successful then the mayor would have grounds for a wrongful discharge and each of the council can be held liable for the actions of this council.
The only remedy is to offer one of three choices to these council members
1. Take leave from MIC employment while they serve out their term in office
2. Have the employee resign or be fired from their position
3. Have the council member resign their term of office to keep their MIC employment

M. Delegation of Authority
The governing body of the Metlakatla Community is the Council which has the responsibility for carrying out the motions, resolutions, grants, contract agreements and regulations for the administration of the Metlakatla Indian Community’s affairs.
In order that the Metlakatla Indian Community’s business may be carried out in an orderly and efficient manner, two guidelines must be followed.
1. Neither the administration nor any of its employees may direct or attempt to control the deliberative activities of any Council Member.
2. No Council Member shall direct or attempt to control the work activities of any Metlakatla Indian Community employee except through the City Manager or his/her designee.

E. Political Activity
Every employee has the right to freely express his/her views and to vote. In order to insure that the Metlakatla Indian Community will operate as fairly and effectively as possible, and to protect the rights of employees and insure that they are free from imposed political influence and are able to administer programs without bias or favoritism arising from political influence, the following policies shall be in forced with regard to political activities.
1. No employee of the Metlakatla Indian Community shall be involved in any political activities during the employee’s regular working hours unless such employee is on annual leave or leave without pay as authorized by the immediate supervisor and the appointing authority.
2. No employee of the Metlakatla Indian Community shall use any materials, facilities, equipment, phones, vehicles, etc. for any political activities at the expense and on their own time. Violation of any of the above policy shall be cause for disciplinary action.
3. No employee of the Metlakatla Indian Community shall, while engaged in political activities, interfere with performance of duties of any other employees. All political activities engaged in by employees shall be done at their own expense and on their own time. Violation of any of the above policy shall be cause for disciplinary action.


F. Conflict of Interest
An employee’s private activities of a political, economic, or other nature, which conflict with or raise a reasonable question of conflict of interest with his/her duties as an employee of the Metlakatla Indian Community, shall not be permitted.
