Hmm... this is hard. I agree with Tabby because they WERE there first but then again they DID do dameges to dream valley. So just sue them for just half the price.

Mom, yes I called her mom, should pay up for the damages. Also the children should be removed immediately from this adusive parent and they should recieve physchiatric care. Also her home should be siezed if no payments are made and be put under the care of some good magical creature. Mwaa hahaha!

Well they did cause the ponies pain to see their castle gone and they had to make a long journey to get to the flutter ponies but i guess i'm just not sure who should pay-

Yep-they're gonna' pay!
After pondering this issue, I must say the witches should not be sued for any damages caused by the Smooze, at least not to Dream Valley. After all, they were in the area first; the ponies moved in without consulting them and drastically changed the landscape. Henceforth, the witches had every right to attempt to retrieve their land by use of the Smooze.
