So I suppose that Carol Kendall--who wrote a book featuring a character named "Muggle" years before Stouffer scrawled that garbage (I've had the ill fortune of actually *reading* part of "Rah and the Muggles")--is also a fraud who's violating Stouffer's copyright?

I hope you know that those characters were from completely different books--even more obscure and less well-written than "Rah and the Muggles."

Nope.

Stouffer's books were never available outside of the U.S., and didn't even sell well here, because--quite frankly--they suck.

Rowling is British, and she'd never heard of the books before this entire fiasco started.

By your reasoning, I could sue Disney for fraud over "Gargoyles," since I came up with creatures similar to Disney's gargoyles in the late '80's. I could also sue Don Bluth Productions over "Titan A.E.," since I wrote a similar storyline (okay--it had at least as much similarity to "Titan A.E." as Stouffer's books have to Rowling's) in '95.
