Three MPs to face leadership tribunal

THREE more members of parliament will be appearing before a
leadership tribunal for direction hearings next Monday.
The three leaders are Tewai-Siassi MP Mao Zemming,
Usino-Bundi MP Peter Yama, and Mendi MP Michael Nali.
Justice Timothy Hincliffe will chair the tribunal and senior
magistrates Manouluk and Manue will assist him.
Meanwhile, on Friday, Nuku MP Andrew Kumbakor,
Yangoru-Saussia MP Bernard Hagoria, and former National
Gaming Control Board chairman Alfred Daniel appear for a
direction hearing before another leadership tribunal chaired by
Justice Salamo Injia.
The Ombudsman Commission referred most of these leaders
were referred to the Public Prosecutor because they were
implicated for alleged misappropriation of public funds.
Mr Nali is alleged to have led a riot, obstructed and disturbed
election proceedings during the course of a by-election in the
Southern Highlands province in 1999.
Mr Zemming's referral relates to allegations of improper
application of electoral funds by cash payments of about
K504,000 from 1998 to 2001 and the improper application of
about K1.1 million of electoral development funds to
companies owned and controlled by his associates in 1999.
Mr Kumbakor was referred for alleged obtaining motor vehicle
allowances from the National Parliament under false
pretences, employing an associate who received receiving
salaries from both the National Parliament and Department of
Treasury and alleged misapplication of K63,000 in public
money from the National Gaming Control Board.
Mr Hagoria was referred for the alleged misapplication of
K1.21 million of electoral funds in respect of the years 1997,
1998 and 1999 for the Yangoru-Saussia open electorate,
contrary to guidelines.
Mr Yama was referred for his alleged failure to acquit
advances from Water Supply drought relief funds, misuse and
failure to acquit Law and Order funds, improperly using
Electoral Development funds, misapplying and failing to acquit
claims to himself and inequitably distributing Rural Transport
Development funds, using family companies to purchase
houses in an irregular manner from the National Housing
Corporation, not disclosing or not obtaining approval for his
private company to enter into publicly funded contracts,
attempting to purchase two ships from the State at below
market prices and using his official position to obtain a private
bank loan to purchase a ship. Some of these date back to
1997 when Mr Yama was member for Sumkar open, also in
Madang.
Mr Daniel's referral relates to allegedly received excessive
payments as chairman of the National Gaming Control Board,
unlawfully receiving reimbursements for expenses related to
Manus province which does not have gaming machines,
unlawful receipt of entertainment and meal expenses,
unauthorised receipt and abuse of a mobile phone, motor
vehicle and fuel card, misuse of his position as chairman to
engage a company he was closely connected with and failure
to promptly lodge annual statements to the Ombudsman
Commission.
