Subject: Miami-Dade County's "Pit Bull" Ordinance

I have already responded to the following post, but thought that others might want to.

"We are looking for your support and any supporting information you can provide us to help overturn the Miami-Dade County's "Pit Bull" Ordinance.
In the past weeks there has been an enforcement of breed specific legislation, specifically the "Pit Bull" Ordinance in Miami-Dade County. A very large group of dog owners have been affected. We plan to fight this Breed Specific Legislation in Miami-Dade County
(Chapter 5 - Section 5-17) at a hearing in the next few weeks considering the following:
By singling out one breed of dog for destruction, the pit bull dog ordinance raises two constitutional problems: first, because many breeds of dogs can cause harm to people, an ordinance that classifies only one
breed as vicious appears to be arbitrary and under inclusive and therefore, violative of the dog's owner equal protection rights as stated by the 14th amendment. Second, because the ordinance is structured to apply only to pit bulls, the law implies that there is some method of determining a dog's breed. Because identification of a
dog's breed with the certainty necessary to impose sanctions on the dog's owner is impossible, such ordinances have been considered unconstitutionally vague and, therefore, to violate due process.
