Austintown Ohio Considers Breed Specific Legislation

July 13,2002- Tom Jones, Austintown resident and show dog owner alerted
Canine Friends of Cleveland (CFC) to Home Rule Resolution 02-01. The
ordinance covers dangerous and vicious dogs, endangered species and exotic
animals.

The next hearing for the ordinance is July 22nd at 7PM, note address below
in the contact information. Please mark your calendars and plan to attend if
you are located in the greater Mahoning County, Ohio area, as the ordinance
could pass into law on the 22nd.

PROBLEMS WITH THE PROPOSAL

VICIOUS BREED BAN
The proposal has a section titled "Prohibition of Certain Vicious Breeds".
Currently, wolf-dog mixes are named. It is a slippery slope to have this
section, as additional types of dogs can be easily added. There is no
scientific or other conclusive test to determine what breed, type or mix a
dog is.

NOTIFICATION
Any owner of a vicious dog or a dog commonly identified as a Pit Bull Dog is
required to give written notice to all of their neighbors that they have
such a dog on their premises. This is an outrageous invasion of privacy.
Currently in Ohio, the neighbors are notified if a convicted pedophile or
sexual predator is moving into the community. One must ask Austintown
officials why pet owners need to be treated in this manner, especially when
based on the appearance of their pet without any other just cause.

INSURANCE
In addition to Ohio State law's requirement of $100,000 liability insurance
for vicious dogs, owners of pit bull type dogs must carry an additional
$1,000,000.000 (One Million Dollars) of coverage.

Using responsible dog owner Tom Jones as an example: He will be required to
maintain individual polices of $1,100,000.00 on his dogs, which are titled
show dogs who visit nursing homes. A neighbor whose dog seriously bites
someone needs only $100,000.00 of insurance to keep their pet. This is the
highest level of insurance CFC has seen in Ohio to date, and it is more than
ten times what state law requires.

VIOLATES FEDERAL ADA PROVISIONS
The proposal exempts dogs that are assistance dogs serving handicapped
owners. However, the proposal states that if the service dog is a dangerous
or vicious dog, they are not exempt. Since the proposal classifies pit bulls
as vicious, any service dog with short hair and muscular build is at risk.
The language of this section is in conflict with the Americans with
Disabilities Act.

YOUR HELP IS NEEDED TO DEFEAT PROPOSAL
Tom Jones, Austintown resident, is requesting help from the dog fancy to
defeat this proposal. At this point the township appears receptive to new
and better ways to handle animal control in their community. Please use the
