Bellevue proposal puts constraints on pit bulls

Pit bulls wouldn't be banned from Bellevue, but they would be considered vicious animals under a proposal that is headed to the City Council.

Pit-bull owners would have to get $100,000 of liability insurance, install 6-foot fences and muzzle their dogs when they were off their property.

"This gives us a way for these dogs to be identified and watched," said Bellevue City Attorney John Herdzina. "And if their owners don't abide by the rules, the dog can be confiscated."

Last month, Theresa Hatcher, a member of the Bellevue City Council, raised the idea of banning pit bulls. Hatcher, an emergency-room doctor, had treated an Omaha toddler whose testicles were bitten off by a pit bull.

Herdzina said cities that ban pit bulls have long, unwieldy and complicated ordinances. This plan, he said, puts "practical constraints" on the dogs and their owners.

The restrictions would apply to a pit bull even if it hadn't shown violent tendencies.

Among the proposed restrictions:

If the dog is outside, on its owner's property, it must be secured behind a fence that's at least 6 feet tall. The fence must prevent the dog from getting out and children from getting in. A warning sign must be posted.

When the dog is taken out in public, it must be muzzled and kept on a 3-foot leash, or put in an escape-proof cage or crate.

If the pit bull were to get loose, police or animal-control officers would be authorized to kill it.

People who violated the ordinance could face a fine of up to $300.

The ordinance will be introduced at Monday night's City Council meeting. However, a public hearing won't be held until the council's March 11 meeting.
