Summary of the Meeting Minutes....

COMMITTEE ON ORDINANCE
Ellen O'Hara, Chairwoman)

12-01-4 "ORDINANCE IN AMENDMENT OF CHAPTER 4 OF THE CODE OF THE CITY OF CRANSTON, 1970, ENTITLED 'ANIMALS' (VICIOUS DOGS)., AS AMENDED".

Councilwoman O'Hara stated that the Ordinance Committee met on February 14, 2002 and recommended approval of this Ordinance.

On motion by Councilman Mancini, seconded by Councilman Nardolillo, it was voted to remand this back to the Ordinance Committee fore more work and more study. Motion passed on a vote of 8-0. The following being recorded as voting "aye": Councilmen Mancini, Nardolillo, Councilwoman O'Hara, Councilman Hersey, Councilwoman McFarland, Councilmen Aceto, Lanni and Council President DeLorenzo -8.

Randall Jackvony, 198 Burdick Dr., appeared to speak regarding proposed Ordinance 12-01-4. He stated that this Ordinance singles out specific breed of dog and is not fair to the owner. There are dogs, whose owners train them to be vicious, they should be targeted and not the responsible dog owners.

Peter Carnevale, 4 Council Rock Rd., appeared to speak regarding proposed Ordinance 12-01-4. He stated that he takes exception to specific breed legislation. He would like to see the statistics warranting such an Ordinance and would like to see the constituents who are looking for this Ordinance to pass. This legislation would bring extra financial burden on good families with good dogs and he read from the federal legislation. Council President DeLorenzo stated that he spoke to three insurance companies today and they stated to him that they will not insure a homeowner with a pitbull. He asked if this is correct. Mr. Carnevale stated that he is stating that his homeowners insurance does cover pitbulls.

Albert Benetti, 24 Concord Ave., appeared to speak and stated that he came to support proposed Ordinance 12-01-4, but after listening to Mr. Carnevale, he feels this needs more study. He asked how we can get individuals who cause problems. Pitbulls and rottweillers are usually owned by criminal element. Everyone who has a dog as a pet, should have insurance and fenced in yard. Amendments need to be made making it more enforceable. Mr. Benetti also spoke regarding Undocketed Resolution passed earlier and stated that residents will pay either directly or indirectly.

Kenneth Stafford, 500 Oaklawn Ave., appeared to speak and stated that he has been a letter carrier for 17 years in Cranston and he has been attacked six times, but never by a pitbull.

Steven Scotti, 121 Keith Ave., appeared to speak for a family member, who owns a pittbull, in opposition to proposed Ordinance 12-01-4.

Judith Maddalena, appeared to oppose to proposed Ordinance 12-01-4 breed specific section. She stated that we cannot compare the City of Cranston with Providence or Pawtucket Ordinance. There are no breed specific sections in these two City's Ordinances.

Jeannine Tucker appeared to oppose to proposed Ordinance 12-01-4 breed specific section. She is a volunteer in rescue work with pitbulls. She urged everyone to educate themselves about pitbulls by searching the net and also educate the constituents.

Carol Bijon, 17 Fairbanks St., appeared to oppose to breed specific section of proposed Ordinance 12-01-4.

Lora Barber, 1190 Pippin Orchard Rd., appeared to oppose to breed specific section of proposed Ordinance 12-01-4.

Kenneth Guilmette, W. Greenwich, appeared to speak regarding proposed Ordinance 12-01-4 and stated that this Ordinance does not state enforcement issue or no mention of due process.

Chris Matrullo, 17 Rugby St., appeared to oppose to breed specific section of proposed Ordinance 12-01-4.

Donna Catalano, North Kingstown, appeared to oppose to breed specific section of proposed Ordinance 12-01-4 and stated that she is involved in pitbull rescue
