I went to a mediation with an owner driver at the small business commissioner tribunal once a few years ago. We were not enemies at the time, he still works with us to this day, says we are fantastic to work for and never wanted to blew with us. However we were asking him to sign a contract that had restraint clauses that he wasn't comfortable with, so we went to mediation (I actually called it so we could get a decision, it had been moving too slowly for my liking).

He was a TWU union member, so he told them what he was doing with us. They, as is the norm for unions and lawyers, got very wide eyed and excited at the prospect of having a fight with someone. Didn't matter that he was happy with everything else in the contract, nor that my restraint clauses were not unlawful and were reasonable - even critical - for us to protect our business.

Nope they decided to go full tilt at me - rolled out the same sort of bullshit rhetoric that you just touched on - calling me the big rich guy trying to harm the poor little businessman. I was acting unethically and the union solicitor - backed by the shop steward sergent at arms next to her - made it very clear i was going to be targeted as a business - they would be recruiting all my drivers and would be negotiating better conditions for them etc blah blah blah

Never mind that I was paying their member HIGHER rates of pay than industry standard - higher than their own recommended rates of pay to their members - never mind that the whole fuckn mediation process was designed to be in good faith and that legal representatives were specifically discouraged from being in attendance.

I didn't think it necessary to bring my own solicitors to this meeting. I had/have been to prob a dozen of these over the years and never once did anyone think to get a friggen scumbag lawyer involved.

After listening to her crap for 45 minutes she eventually got to me, and I exploded.

I got up, called her a piece of shit, looked at my driver and said mate I have no blew with you if you want to leave and work some place else for probably less pay then that's your choice, if you want to stay with us you know the t&c's and you are most welcome back and we want you back but please don't bring this vermin union legal scumbag snake piece of crap into our relationship ever again please. And I walked out.

That afternoon the driver rang me and apologised and that was 5-6 years ago and we haven't had a hassle since. Union free. Driver is doing fine financially.

My opinion is unions encourage laziness and love the fight. More for less is their mantra. Solicitors well they can all get dumped too.

Stick labour up your arse they are shit.
