However, given what has taken place historically in bars and restaurants for lo these last 200 years since the Constitution was written, a bit of expounding on the restriction of smoking seems in reasonable order since the Constitution has not heretofore been interpreted to ban smoking in all public places of limited ventilation.

Not to say that I don't think you have a dandy argument for why smoking should be banned in public places, but I think the regulations are a necessity if you really want to enjoy smoke free bars and restaurants.
