Subject: Congress has not specifically declared war as required by the Constitution

Suit to stop war goes to appeals

BOSTON -- A lawyer for a group of congressmen and servicemen trying to challenge President Bush's authority to attack Iraq asked an appeals court Monday to reconsider their lawsuit.

"The Security Council has clearly not authorized this war, and yet the president has indicated he is proceeding to launch an invasion nonetheless," said John Bonifaz, lead attorney for the plaintiffs.

The lawsuit was filed last month by six Democratic congressmen, three servicemen and parents of servicemen who claimed that even though Congress authorized the use of force with Iraq in an October resolution, it has not specifically declared war as required by the Constitution. The court didn't immediately indicate if it would reconsider the lawsuit. -- ASSOCIATED PRESS
