'John Doe' in Corporate Cybersmear Case Counterclaims for More than $1MM
On August 26, a 'John Doe' Defendant sued by Itex Corporation in a corporate cybersmear case filed last year filed counterclaims and third-party claims against the company and certain of its officials including one for securities fraud. The counterclaim alleges, among other things, that the creation and issuance of bartering "Trade Dollars" in circumstances that the defendant alleges "were in a deficit condition" constitutes "an offering and sale of unregistered securities" in supposed violation of Oregon's blue sky laws. The "Trade Dollars" could be used in connection with bartering arrangements through the company's Web site.
