Letter from a son of the late Capt. James J. Kelly to civil rights veterans, newspaper editors and to whom it may concern.

The Irish papers of 22/09/06 carry a description of how a Donegal garda apologised to the Tribunal for forging interview notes in the case of Roisin McConnell who with twelve others were wrongly arrested in connection with the death of Richie Barron.

In the 1970 Arms Trials the statement of the Chief State prosecution witness was extensively edited before being included in the Book of Evidence. When the State papers were released to the National Archives in 2001, the extent of the editing was made very clear. In subsequent statements made by Desmond O’Malley (former Minister for Justice) and Michael McDowell (Attorney General at the time) in 2001, the lawyers who changed the statement were named. The editing was done at Garda Headquarters under great secrecy. In McDowell’s statement he enclosed a letter showing that the lawyers were given a stipend of 100 guineas for the juniors and 150 guineas to the seniors for their work which necessitated working “days and nights on the case”.

In a letter from the Garda Commissioners Office, ref.ops.79c 3/01 it was made clear that the Gardai did not doctor the evidence but co-operated with the lawyers “assigned by the Attorney General’s Office” by typing the statement for the Book of Evidence. In his report Mr. McDowell said: “I have not attempted to formally interview any of the surviving lawyers or Gardai. I have had brief informal conversations with some of the lawyers involved” .This is the extent of the investigation.

The revelations point to the subversion of the institutions of State by the Government of the 1970’s. When are we going to see the good name and reputation of Captain Kelly properly restored. Although acquitted at the trials he was pilloried for years by dragging his good reputation in the mud. He died begging the Government to clear him. Only a clear indication from the Government will bring closure to this debacle. I await the outcome.
