Miss Earth Telecast restricted as Trademark in India & USA held by M.S.Earth Events India Pvt. Ltd.


Miss Earth telecast on Star TV has been restricted as the Trademark of this event is held solely by M.S. Earth Events India Pvt. Ltd. in USA and India where the company had applied for this Trademark since 1999, and has also received its certificates in both these countries. Obviously, no program or event with the same or even similar name can be produced or telecast in India or USA without permission from M.S. Earth Events India Pvt. Ltd. Permission was not sought by the party who sold the telecast rights of an event that they produced with the same name in the Philippines.



Carousel Productions, a Philippines based company had hosted a similar pageant of the same name amounting to Trademark infringement. In fact, Star TV was scheduled to telecast the event on November 28th. The channel was airing promos of the event on its popular programs on Star World with sponsors like Samsung and Suzuki Baleno taking the presenting rights. It has also come to the company’s notice that Carousel Productions has been using the name Miss Earth in USA as they source participants from there. Reports indicate that the very popular Miss Afghanistan who represented her country for the first time was also sourced from the USA. It has been clarified that Carousel Productions could have given the program for telecast in India and USA only if they had permission or licence from M.S. Earth Events India Pvt. Ltd. who own the Trademark in both these countries.



M.S. Earth Events India Pvt. Ltd. has now taken the matter to court for Trademark infringement and has won a temporary injunction order that bars Star TV from telecasting the event. In fact, the channel has even stopped airing the promos. The schedules for Star TV Programmes also show that Miss Earth has been replaced by a different show. M.S. Earth Events India Pvt. Ltd. is now in the process of initiating legal proceedings against Carousel Productions in USA also.
