He violated the terms of his contract that he signed when he joined, which stated he would be bound by the UCMJ.
His oath, sworn to obey the lawful orders would have been the oath he made on his commissioning after his training.
Now, as Congress and the Senate voted to send troops to Iraq,
the troops are then under the command of the POTUS and his designated officers.

You see, my dh was commissioned as an officer under Clinton.
