Groups Sue NYC Over Rally Permit Refusal

NEW YORK - Organizations opposed to a war with Iraq sued the city Wednesday for denying permission for a rally and march past the United Nations next week. The city wants them to use a plaza across the street instead.

The federal lawsuit argues that the city is violating the First Amendment rights of the protesters and requests a judge's order that a permit allowing a parade of 50,000 to 100,000 people be issued by the city.

A coalition called United for Peace and Justice said it planned a large anti-war march and rally on Feb. 15 that would include marching past the United Nations. It called the march essential because the international organization is responsible for monitoring activity in Iraq, including weapons inspections.

Instead of a march, the city offered to allow a stationary rally on a plaza across the street from the United Nations.

The demonstration was timed to follow the Feb. 14 date on which the next inspections report is due to be forwarded to the U.N. Security Council.

A message left with city attorneys wasn't immediately returned.

Chris Dunn, a staff attorney for the New York Civil Liberties Union, who filed the lawsuit for the anti-war group, said the city had refused to permit a parade under any circumstances, citing concerns over congestion and related issues.

The court papers noted that the city routinely issues permits for large-scale marches in midtown Manhattan, including the St. Patrick's Day parade and the Thanksgiving Day parade.
