Subject: How do you correct a leak on a "Flat roof"

the roof on my den "flat roof" with a 3 to 3 and one half pitch was shingled 4 years ago. We had two leaks and the last did major damage. the roofer says the roof is not insured and he says the flat shingles on the roof are causing the problem. Who is responsible for this leak. the old flat roof lasted 25 years
i thought a flat room was flat void of a pitch? Need answer immediately. thank you

You should have gotten a written workmanship warranty from your roof contractor and he would have to take care of it or he would be liable for the repairs done by someone else in a small claims court. If its 3/12 to 3.5/12 you shouldn't be having these problems. This is definitely not a "flat roof" though it would be considered a low pitch roof and he should have followed manufacturer's specifications for low pitch installation. The manufacturer is not responsible because this is not a product failure but an installation failure. For all that read this let this be a lesson in getting a WRITTEN workmanship warranty. I give 10yr to 30yr workmanship warranties on my roofs. Any failure after ten years will most likely be a product failure. After the initial installation of the roof up to about 8 years of age is when installation failure usually appears.

SO WHO'S RESPONSIBLE?
Without a workmanship warranty I am sorry to inform you that you will have to take care of this. A lot of roofing manufacturers won't even stand by their warranties if you don't get the proper documentation from your contractor at the time of install.

What you should get from your roofing contractor at the time of payment?
1) Your copy of the manufacturer's warranty with info filled in concerning your roofing contractor filled out by them. Some manufacturers require that you register your warranty and for some its only recommended. If your product has a transferable warranty you will want to register it to make transfer possible down the road. Non-registered warranties are usually only valid to the original owner of the roof installation.
2) A written workmanship warranty that states its coverage clearly holding the contractor responsible for his part of the installation. Most roofing companies have workmanship warranties that clearly don't cover product failure letting the manufacturer's warranty take care of this but the manufacturers don't cover labor and only product cost. Some manufacturers such as CertainTeed's warranties come with a "Sure Start" period with their products that cover the additional labor costs of a product failure for a short period of 3 to 10 years depending on the product.
3) You copy of the billing invoice.

These are the things you'll want to keep together in case of problems down the road. I've actually seen companies that give you nothing but a billing invoice and you'll have a tough time down the road getting any warranty service out of these contractors as we'll as the from the manufacturers although with thorough proof that that is there product on your house most manufacturers will stand behind their products.
