Sevua rebukes lawyer over poll petition

NATIONAL Court judge Justice Mark Sevua has castigated a lawyer in an election case for “wasting the court’s time” after he failed to back his client’s petition with pertinent law.

Lawyer David Tambili was advised that when making an application to seek court interim orders, his client’s claim must be accompanied by a pertinent provision of the law.
This was especially when it involved something “serious” like attempting to stop the Electoral Commission from doing its work.

Justice Sevua told Mr Tambili that there were already five election petition cases pending in court and that they needed to be dealt with quickly before polling begins.
“Why should the court waste its time on an applicant seeking relief if it failed to cite pertinent laws to back its case?” he asked.
The petition, which was in the form of an urgent application, was filed by Peter Komiti, a candidate for the Kompiam-Ambum open seat in the Enga province, who is asking the court to restrain the Electoral Commission from using the updated common roll in his electorate.
Mr Komiti wanted the updated common roll nullified and that he had claimed there was anomaly in the updated voters’ list because 7,583 names had been added to it.
He also petitioned the court to remove returning officer Luke Waiyon and be replaced by his assistant Herman Yongapen.
A hearing had been set for Thursday to look into the case before another judge.
Mr Komiti had alleged that current member Dickson Maki and a former member who is running for the same seat had connived to pad the voters’ list with “ghost names”.
Mr Komiti was demanding that the polling must be held using the pre-liminary roll instead of the current one.
A hearing had been set for Thursday to look into the case before another judge.

John Pundari and Dickson Maki to blame - the rotten apples causing all the fuss

News Tuesday 26th June , 2007

Officers set to resign in Enga

THREE assistant returning officers for an open seat in Enga Province will resign amid pressure from candidates over discrepancies in the electoral roll.
The National Broadcasting Corporations Karai radio has reported three assistant returning officers for the Kompiam-Ambum seat were to give their resignations to Enga election manager Henry Kyakas yesterday.
Attempts to contact Mr Kyakas yesterday to confirm the report were unsuccessful.
Kompiam-Ambum candidates have alleged the electoral roll for some communities have been illegally inflated or undercounted. Some polling officials also allegedly worked as security guards for a former MP who is now a candidate for the same seat in this general election, they added.
Electoral officials have come under intense scrutiny from candidates in the five Highlands provinces since the close of nominations and start of campaigning on May 10.
Candidates in Southern Highlands Tari-Pori Open seat echoed similar sentiments recently when questioning the appointment of a number of polling officials, whom they alleged were aligned to certain candidates.
Southern Highlands will be the first Highlands province to vote this Saturday, followed by Enga July 4, Western Highlands July 6, and Chimbu and Eastern Highlands July 9.
