Students freed on rape charge
TWO University of Technology students charged with the rape of a young girl walked out of court to freedom on Friday. Senior commital courts magistrate Posain Poloh dismissed the rape charges against Eddie Kopio, 20, a first year civil engineering student from Wapanamanda, Enga province and Moses Frank, 20, a second year civil engineering student also from Wapanamenda. The court held that there was insufficient evidence to commit the two students to stand trial before a higher court over the allegation they raped a girl in one of the student's room on the night of July 31, 2006.
Both students were arrested and charged that they sexually penetrated the girl without her consent. A statement by the alleged victim read in court said she had gone to the Unitech campus to find her boyfriend. As it was getting dark, a male student approached her and asked her who she was waiting for. The male student later asked her to go with him to his room and wait there while he would go to find the boyfriend. She alleged that the boy returned to the room a little later and after switching off the lights, forced her to remove her clothes and raped her.
She said after he left the room she tried to escape, but noticed there were other boys around so she went back into the room. She went to sleep on the bed but was awoken by another student who forced her to remove her clothes and raped her again. She said she managed to escape from the room and was rescued by security guards at about 3:30am. She was taken to the police station, then to the hospital for a medical check. But presiding magistrate Mr Poloh said the statements by the alleged victim and a security guard were contradictory. Mr Poloh also said the girl had been in the room for about nine hours. It did not make sense that she could not get away or seek help.
------
This is outrageous for the courts system to let off the hook rapists like this.
The public has no confidence whatsoever on the magistrates and judges who handled this case and dismissed it like that.
The unavoidable and inexcusable naked truth is that, this young lady was raped against her wishes by two educated future leaders of PNG.
