Subject: I agree are you qualified to be the State's Attorney?
In reply to: Ann 's message, "ARE YOU QUALIFIED TO BE A PROSECUTOR" on 06:46:21 08/27/02 Tue

Your changes to the State's Attorney's office are all directed at police work. Are you saying that what the police in Charles County are doing needs to be changed and they are not doing it correctly?

How many jury trials have you tried where you were the only attorney representing your client?

Thanks,

Dale

Thank you for taking time to visit my website and make inquires. I will attempt to answer your questions. If you believe I have not or would like additional information feel free to call and make an appointment, I will gladly discuss my entire platform with you.

My qualifications exceed that of my opponent in that I have more management experience. I supervised an office of over 100 investigators and 20 or more support personnel. We were responsible for investigating over 1500 murder cases and several thousand more death investigations. Our accomplishments gained national recognition as we were able to significantly reduce the murder rate and increase the clearance rate and our work led to the sucessful prosecution of more murder cases than at any time in the history of the city. This occurred at a time the city was going through a serious financial crisis and the murder rate continued to rise nationally. I have also been sucessful in private industry as a businessman something my opponent has not. I have not done the research but I can't remember the Charles County State's Attorneys office, under my opponents leadership, being recognized nationally for anything.

I have proven my ability as a crime fighter. I can foster strong relationships with the community to enhance the effectiveness of our law enforcement efforts. Repeatedly, I have been called upon by international and national television newspersons to offer my analysis about cases and prosecutions. Furthermore, I am called on regularly to instruct attorneys and law enforcement on case management, trial preperation and other issues.

What I have proposed may seem like police work because it is law enforcement work. The State's attorney is the lead law enforcement agent for the County and I believe owes the county more than just reacting to crime. Given the way the current State' Attorney has performed his job one could understand why you might think my platform is police work. Law enforcement's primary job is to make our community a safe place to live and work. A comprehensive, multi-faceted approach to crime and problems contributing to crime will help prevent crime and improve the quality of life in our community. Anyone in law enforcement who really cares about the community would see it that way. My crime prevention component is but one facet of my platform.

I believe our police in Charles County are doing a good job but they need help from everyone in the community, especially the law enforcement community which includes the State's Attorney. My office will work hand-in-hand with the police to ensure ALL efforts are made to make our community crime free.

Finally, I don't have an exact number of jury trials I have been involved in but I would estimate it to be several dozen more than my opponent over the last four years. Of those two have been with co-counsel. Further, I have been intimately involved in over 200 jury trials most of which were for murder. My role there was putting the case together, bringing the evidence to the prosecutor, and testifying in court, in effect making the case. I'll let you in on a little secret, having performed both roles- being a trial attorney is by far much easier. That may account for the reason so many lawyers dread being called to a witness stand. As an attorney one gets to ask the questions.

Again, I invite you to visit me at my office so we can sit down and I can answer any other questions you may have.

[> [> Your qualifications -- Jim Smart, 14:41:39 09/27/02 Fri (1Cust237.tnt1.waldorf.md.da.uu.net/67.201.24.237)

I believe you were employed in the "murder capital of the world" and I believe DC is still referred to as that. This is Charles County and we do not have a high homicide rate. Perhaps if this were PG County you might have my attention. And, I feel that our police force is doing a great job. I think they probably work quite well with our State's Attorney's Office, perhaps that is why Mr. Collins received the endorsement by the Fraternal Order of Police.
But, nonetheless, I still do not see why you feel you are better qualified for the job. Other than the fact that you have testified on a great number of trials, have you ever actually been a prosecuting attorney? I believe you just received your law degree about 4 years ago and have been in private practice since.
You claim that the State's Attorney's office has never been recognized nationally for anything. Charles County isn't even on the map! Did you single handedly fight crime or were you part of a much larger force? I believe Mr. Collins, our current State's Attorney, is the first State's Attorney in Southern Maryland to be elected by his fellow State's Attorney to serve as President of the State's Attorney Association. I should think that this type of honor should be one that does not go unrecognized.
I also believe that you do NOT have more experience than Mr. Collins simply because you have never prosecuted a single case. You have never been an assistant prosecutor. You have never supervised the Office of the State's Attorney. I could have 25 years experience running a chain of fast food restaurants, but that wouldn't mean I would have the same experience running a school system.
I think you are confusing the divisions of law enforcement. If one guy could run the whole show, we wouldn't have branches of government. Everyone can't do everything, and although you talk a good game about crime prevention, I think you will find that there are other issues that will need to be dealt with first.
Thank you.

See my response to Ann. If Mr. Collins is doing such a great job why did he find it necessary to lie to the Fraternal Order of Police to get their endorsement.

Please elaborate on the lies told by the State's Attorney. If this is true, you should have documents to prove it. Otherwise, that is a very powerful statement to make. Please don't invite me to your office.

As I mentioned earlier Mr. Collins lied to the FOP during their candidates forum. You may not want to believe that but I'm afraid its true. I also was appalled that the sitting State's attorney would lie about my testimony and then take credit for what my testimony accomplished. I challenged Mr. Collins on this issue last wednesday night at the Bar Association Candidates Forum. He had every opportunity to challege me on this issue, he chose not to. I do have affidavits from two of Mr. Collins democratic collagues who verify Collins lied. I had them with me on Wednesday night, maybe thats why Mr. Collins chose not to deny it. They are available for inspection in my office or you could call Del. Vallerio and Del. Dembrow and ask them about. You also might call Mr. Collins.

I would also point out that when I challenged Mr. Collins lack of integrity, I did it to his face, with him present, and when he had an opportunity to respond. He chose not to.

I am sorry you feel offended I invite you to my office to see the documents for yourself, the truth can be painful.
