I agree there are a few things making me think Neo could very well be a program... it would just explain a lot easily. but a lot of (independent) characters in the movies call him human.
exp:

- in matrix 1, the agent (brown, i think) states: only human
- the agents in reloaded also do this before they fight neo
- councillor hamann in reloaded thinks that neo cannot sleep is a good sign of him still being human
- even the architect says it himself: "and though the process has altered your consciousness you remain irrevocably human ergo some of my answers you will understand and some of them you will not"

of course, this could all be leading us to BELIEVE neo is human while in fact he is (becoming) a program; but still, having a protein-based body myself I just hope it ain't the case ;-)
