1.John Marshall died 1835, Jackson appoints Roger Taney
2.Doesn't bring sharp change, slowly modifies court
B.Shows new mood in Charles River Bridge v. Warren Bridge
1.Two companies dispute over right to build bridge one Charles River
a.One company had old charter w/state to operate bridge with toll, claimed it gave right to a monopoly.
b.Second company asked for authorization to build bridge with no toll, which reduces value of 1st company.
2.Taney ruled in favor of second company
a.Taney's object was to promote general happiness, more important than contracts and property.
b.Believed that for the good of the community second bridge should be built.
3.1st company made of aristocrats from Boston
4.2nd company made of new aspiring entrepreneurs, whom Jackson distinctly supported
5.Decision showed that key to democracy was expansion of economic opportunity, giving chances to the newcomers
