I have sent in my 15 day notice (for the 30 day out of service rule) and the idiots at BMW took it as a notice of 3 repair attempts! They scheduled a "final repair attempt" (part of the 3 repair attempt rule) when it should have been a manufacture's inspection (under the 30 day out of service rule). That really does not matter. It is just a matter of words. It does, however, demonstrate that BMW does not know what they are doing.

I am sending a notice of 3 repair attempts Tuesday. The letter will note their improper response to the last notice. I will also let them know that I have already arranged (through my local dealership)a "final inspection" with their field service engineer, Guy Carlton, who did the last inspecton/final repair attempt. They will have 10 days to respond and approve his final repair attempt or make other arrangements.

Now here is the problem. My car does not accelerate smoothly from 5500-8000rpm at less than full throttle. The engine hesitates multiple times through that range. The dealership and BMW field service representive have tried to say that the car is fine since there are no codes logged in the DME.

I have brought it on my own to a shop that probably services more BMW than the local dealer. They have the latest BMW diagnostic computer also. He agrees that there are no codes but notes that the pulse width of the fuel injectors are to long but that all the adaptations were midrange. Now I that could explain the problem. Fuel pressure is low, causing the symptoms, but the injectors try to make up for this by increasing pulse width. I think that the adaptation prevents a code from going but apparently is not good enough to keep me from feeling hesitation in the 5500-8000 rpm range. Then again I am a physician and not a mechanic!
