Date Posted: 10:06:03 05/21/02 Tue Hey kiddies, so we don't have discussions that we have already had three years ago here is my take on the two twelve pearls. Way back in 1995 or 96, Jordan and I where rearranging a band we had formed with our youth director in high school. We were bringing on Brandon to replace our youth director as a guitarist and we decided to make a real go at it. To do this we needed a new name and new image. We were freshmen in college and sat at a computer searching for ideas and band names. We brought along our Zondervan's teen study bible. Our vision was to show our Christian roots while never being in the Christian scene. We wanted to spread our real world Christian lives to the real world. We have always wanted that. Just real guys who believe in God, being themselves and writing songs about real life. WE didn't want to be overly obvious and call ourselves the "Jesus Freaks" or somethin'. So we looked to the back of the bible in the concordence for verses close to our hearts. We ended up picking 12 Pearls out of Revelations to reflect the ultimate culmination of our Christianinty and God's promise to us. When we saw that Nebraska had it's own twelve pearls with the same name for the same reason, we were shocked. How could both of us have picked that same random name, from the same random verse? Personally, I think it is kind of a neat thing that it happened, even though it might cause business problems later on down the road. So think of it this way Nebraskans, we both have a vision and a message and we are pursuing it different ways. How cool that we both had the same idea about the music. Now, that being said, let's get down to the business part of it. Trademarks and copyrights are legally binding and are simply a registry of names and logos that the USA uses to keep evrything in order and on record. It also prevents liability for the actions of similarly named companies from falling on the innocent party. However, the right to trademark something also relies on documentation. Yes, Nebraskans, one of your parents had the forthright attitude (and the $100) to copyright the name. The problem is, did you have the right to copyright the name? The answer is no. In a dispute adjudication, we would simply have to produce documented evidence of our band being officially published in some way before the Nebraskans. For example we could produce flyers from our opening gigs with Black eyed sceva, and Waterdeep from our early days. We also have several self-recorded CD's and tapes (that dates us) that bear the year. Do not fret though. The regional copyright is a law that protects the small businesses of America. For example, Joe's restaurant in Omaha, may not know that it is infringing upon the copyright of a restaurant holding the same name in North Dakota. The law says that as long as the two don't interfere with each others markets, that it is OK. That is the case in the 12 P incident. If and when we come to a conflict because we are both trying to get in the same market regionally or one of us goes nation wide, then we would have to have a dispute litigation. Until then my friends, everything is cool. So after this lengthy message, let's leave the Nebraska boys and the OK boys alone with a lot of messages and emails about another 12 P. We know about it and it is fine for now with both parties. Just enjoy our music and rejoice and a pretty neat coincidence. Thanks.
